- This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested for Quotation (RFQ) Q1574075036. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular FAC 2005-16, 22 Mar 07 and are available in full text through Internet access at http://www.arnet.gov/far. All responsible agencies may submit a quotation which shall be considered by the NPS. The North American Industry Classification System (NAICS) code is 324121 and the size standard is 500 employees. The following is a description of the requirements for this acquisition: DESCRIPTION: Yellowstone National Park has requirements for the following types of materials. Successful quoter must be located within drivable 10 mile radius of Gardiner Montana, the North Entrance to Yellowstone National Park. The government contemplates award of a Firm Fixed Price contract resulting from this solicitation. ITEM 0001 Approximately 3100 tons of mix as follows: 2,200 tons of PG 58-28 Hot Mix using a 3 bin aggregate gradation for the mix; 600 tons of MC-800 and 300 tons of MC-250 produced through a hot plant using a 3 bin aggregate gradation for the mix. Quote shall include all labor, materials and equipment necessary to supply the PG 58-28 hot mix at a hot mix asphalt plant to be located by the successful quoter within a 10 mile radius of Gardiner, Montana; the North Entrance to Yellowstone National Park. Due to weather conditions, paving will not occur every day. Days of production could require a minimum of 200 tons to a maximum of 900 tons of hot mix per day. Quote for MC-800 and MC-250 shall include all labor, materials and equipment necessary to supply the material produced through a hot mix asphalt plant. National Park Service trucks will pick up the material and distribute the material through out the National Park. Approximate start date for hot mix is July 1, 2007 subject to award of contract. The following clauses or provisions are specifically referenced and are required in the response to this solicitation: 52.212-1, INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS; 52.212-2, EVALUATION-COMMERCIAL ITEMS - Evaluation factors include [a] price; [b] past performance supported by documentation and three references. Paragraph "a" of the provision is hereby replaced with the following: Award will be made on the basis of the lowest evaluated price of quotations meeting or exceeding the acceptability standards for non-price evaluations factors. The non-price evaluation factors and their associated acceptability standards are: Past performance. Past performance is a measure of the degree to which a contractor has satisfied its customers in the past. Standard of Acceptability: The quoter must receive at least a satisfactory past performance rating. The NPS will evaluate past performance based on, the Government's knowledge of quoter's past performance, and / or references obtained from any other source. 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS, a completed copy of the provision at 52.213-3 must be submitted with the quote; 52.212-4, CONTRACT TERMS AND CONDITIONS-COMMERCIAL ITEMS applies to this acquisition; 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS-COMERCIAL ITEMS, applies to this acquisition including 52222-3 Convict Labor, 52.225-13 Restrictions on Certain Foreign Purchases, and 52.233-3 Protests after award; and, the following paragraph (b) clauses added: 52.222-21 Prohibition of Segregated Facilities (Feb 1999), 52.222-26 Equal Opportunity (E.O. 11246), 52.222-35 Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era; 52.222-37 Employment Reports on Disabled Veterans and Veterans of the Vietnam Era; 52.225-3 Buy American Act-North American Free Trade Agreement-Israeli Trade Act-Balance of Payments Program with alternate 1; 52232-33 Payment by Electronic funds Transfer - Central Contractor Registration. Clause 52.211-16, Variation in Quantity A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) of this clause. The permissible variation shall be limited to 10 Percent increase or 10 Percent decrease. This increase or decrease shall apply to the total quantity to be delivered. Clause 52.217-7, Option for Increased Quantity-Separately Priced Line Item. The Government may require the delivery of all, none or any combination of the numbered line items, identified in the Price Schedule as an option items, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option either at the time of award or by written notice to the Contractor a minimum of 10 days before the contract expires . Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree. Clause 52.217-4, Evaluation of Options Exercised at Time of Contract Award. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate the total price for the basic requirement together with any option(s) exercised at the time of award.
