- The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Ceramics Division, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Kurt J. Lesker Company, for the purchase of a 300W RF Power Supply and Torus Heads (sputter source) in order to upgrade an existing Combinatorial Material System (CMS) Sputtering Tool. Sole Source determination is based on the following: NIST currently utilizes a CMS Sputtering Tool in order to make oxide and metal thin films. The equipment being purchased is for an upgrade to this existing system which was customized to meet NIST?s specifications. The 300W RF Power Supply and Torus Heads (sputtering source) are proprietary hardware for use with magnetic and non-magnetic materials. This purchase also includes proprietary software modifications. Therefore, the required equipment and software modifications must be 100 percent compatible with the existing equipment. Kurt J. Lesker Company is the sole manufacturer and distributor of the Torus Heads, and the sole distributor of the 300W RF Power Supply. These parts are required to satisfy the Government?s minimum requirements. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by June 1, 2007, 3:30 p.m. EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
