- The U.S. Department of Energy, Environmental Management Consolidated Business Center (EMCBC), intends to issue a modification to a contract competitively solicited and awarded by Fluor Fernald, Inc., and subsequently assigned to the U.S. Department of Energy, to Waste Control Specialists, LLC. The modification will extend the contract which provides for the interim storage of the Fernald Closure Project Silos 1 & 2 waste through October 31, 2009, contains an option for services for the permanent disposal of Silos 1 & 2 waste and contains an option for services for preparation and loading of the Silos 1 & 2 waste containers for transport. This is a notice of intent to modify a contract and is not a request for competitive proposals. Firms who want to challenge the sole source must submit an interest letter that demonstrates their firm???s capability to provide service as described herein, including provision of appropriate licensees and permits for storage and disposal of nuclear waste with the characteristics of the Fernald Closure Project Silos 1 & 2 byproduct material. Interested parties must provide rationale as to why they should be considered. Interested parties must demonstrate that they have interim storage capability and licensing permits for the Silos 1 & 2 byproduct material under Section 11 e.(2) of the Atomic Energy Act of 1954 (as amended) (AEA). As 11e.(2) byproduct materials, the residues are statutorily excluded from the definition of solid and hazardous waste under RCRA pursuant to 42 USC 6903(27) and 40 CFR 261.4(a)(4). Interested parties must demonstrate that they meet the specific requirements for management of DOE byproduct materials as defined through the AEA, and implementing DOE Orders, policies and directives. DOE Order 435.1 provides the basis for management of byproduct materials defined by section 11 e.(2) of the AEA at DOE low-level waste facilities pursuant to DOE???s authority under the AEA. The basis for management and disposal of materials at a commercial facility would be provided by the applicable NRC or state regulatory agency licensing regulations. Interested parties must demonstrate that they have all of the following: (a) all necessary facilities, equipment and personnel to provide the services for Silos 1 & 2 byproduct material interim storage; (b) all necessary permits and licenses (copies of such shall be provided with interest letter); (c) licensed capability for the storage of the 3776 containers of Silos 1 & 2 byproduct material under Section 11 e.(2) of the AEA (as amended) through October 31, 2009; (d) capability to perform and document all necessary inspections required under the required and applicable license(s); (e) capability to maintain and perform repairs to the 3776 containers containing the Silos 1 & 2 byproduct material for container integrity for future shipping or disposal. The contract action also contains an option for the permanent disposal of the containerized Silos 1 & 2 byproduct material under Section 11 e.(2) of the AEA (as amended). Interested parties are advised that DOE will issue a future synopsis prior to exercising the option for the permanent disposal of the containerized Silos 1 & 2 material. Firms who want to challenge the exercise of the option for the permanent disposal must submit an interest letter that demonstrates their firm???s capability to provide service for the permanent disposal of the Silos 1 & 2 byproduct material. Interested parties must demonstrate at the time of the future synopsis that they have: (a) all necessary facilities, equipment and personnel to provide the services for Silos 1 & 2 permanent disposal; (b) all necessary permits and licenses for the permanent disposal of the 11e.(2) Silos 1 & 2 byproduct material (copies shall be provided); (c) sufficient licensed capacity for the permanent disposal of the 3776 containers of the Silos 1 & 2 material; (d) capability to perform all activities associated with the Silos 1 & 2 material in accordance with all applicable Federal, State and local statutes, regulations (e) upon disposal of the waste, take title to the containerized waste (f) capability to approve and process all waste acceptance profiles. If a firm currently has the above capabilities for permanent disposal of the Silos 1 and 2 byproduct material under material under Section 11 e.(2) of the AEA (as amended), the firm should immediately notify the DOE and provide the above required information. All interested firms must respond to DE-AC24-07CC00029 by May 31, 2007, 3:00pm, Eastern Daylight Savings Time, to Timothy L. A determination by the Government to not compete this proposed modification based upon responses to this notice is solely within the discretion of the Government. Information received will normally be solely for the purpose of determining whether to conduct a competitive procurement. DOE will not reimburse for any costs connected with providing the capability information.
