- This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. This notice is being issued as a Request for Proposal for the procurement, storage acceptance, and delivery of two lots of lithium ion batteries (6000 batteries per lot). One lot of lithium ion batteries must be from E-one Moli Energy (Lot A), and one lot of lithium ion batteries must be from ABSL (Lot B). (Please see attached Statement of Work at: http://procurement.jsc.nasa.gov/NNJ07200381Q/SOW_5_28_07.doc ). Offerors may propose on either Lot A, Lot B, or both. The Government may award both lots to one offeror or may award each lot to separate offerors. The provisions and clauses in the RFP are those in effect through FAC 05-16. This procurement is a total small business set-aside. See Note 1. The NAICS Code and the small business size standard for this procurement are 335911 and 500 employees respectively. The offeror shall state in their offer their size status for this procurement. All responsible sources may submit an offer which shall be considered by the agency. Delivery is required: Basic: 10 months after contract award; Option 1: 11 months after contract award Delivery shall be FOB Origin. The DPAS rating for this procurement is DO-C9. Offers for the items(s) described above are due by 1:30 local time on June 11, 2007 to NASA/JSC, Attn: Julie K. Karr/BH2, 2101 NASA Parkway, Houston, TX 77058 and must include, solicitation number, FOB destination to this Center, proposed delivery schedule, discount/payment terms, warranty duration (if applicable), taxpayer identification number (TIN), identification of any special commercial terms, and be signed by an authorized company representative. Offerors are encouraged to use the Standard Form 1449, Solicitation/Contract/Order for Commercial Items form found at URL: http://server-mpo.arc.nasa.gov/Services/NEFS/NEFSHome.tml Offerors shall provide the information required by FAR 52.212-1 (JAN 2006), Instructions to Offerors-Commercial, which is incorporated by reference. If the end product(s) offered is other than domestic end product(s) as defined in the clause entitled "Buy American Act -- Supplies," the offeror shall so state and shall list the country of origin. FAR 52.212-4 (SEPT 2005), Contract Terms and Conditions-Commercial Items is applicable. FAR 52.212-5 (JUNE 2006), Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items is applicable and the following identified clauses are incorporated by reference: 52.219-6, 52.219-14, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-1, 52.225-13, 52.232-34. The FAR may be obtained via the Internet at URL: http://www.acquisition.gov/far/index.html The NFS may be obtained via the Internet at URL: http://www.hq.nasa.gov/office/procurement/regs/nfstoc.htm OTHER CONTRACT REQUIREMENTS OR TERMS AND CONDITIONS The offerors must procure one lot of batteries from E-one Moli Engery and one lot of batteries from ABSL. These two cell designs uniquely meet the specific energy (Wh/kg) and life requirements of the Extravehicular Mobility Unit (EMU) battery. All contractual and technical questions must be in writing (e-mail or fax) to Julie Karr not later than June 5, 2007. Telephone questions will not be accepted. Selection and award will be made to that offeror whose offer will be most advantageous to the Government, with consideration given to the factors of proposed technical merit, price, and past performance. It is critical that offerors provide adequate detail to allow evaluation of their offer. (SEE FAR 52.212-1(b)). This includes details of how the offeror will perform or deliver the following: A. Careful, consistent, and uniform handling of the cells throughout the contract period of performance. B. Test Performance Quality ? Explain what methods proposed will ensuring that outlier cells are properly and accurately identified. C. Deliverables ? Clearly written, well-organized, and comprehensive test documentation. Potted cross-cut samples that capture salient features of the cell design without distorting them and enable precise dimensional examination of internal cell components. Cross cut samples delivered with the proposal are encouraged will aid proposal evaluation and selection. Offerors may propose on Lot A, Lot B, or both Lot A & B. If an offeror proposes on both lots separate prices for Lot A and Lot B are required as well as a price for both lots. The offeror shall price the storage of the cells at a montly price for the maximum amount of months. The maximum number of months for the basic order is 10 months; Option 1 requires an additional month of storage for a total of 11 months of storage throughout the period of performance. The Government may award both lots to one offeror or may award the two lots to different offerors. Option: The Government will evaluate offers for award purposes by adding the total price for the option to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options. Offerors must include completed copies of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items with their offer. These representations and certifications will be incorporated by reference in any resultant contract. An ombudsman has been appointed -- See NASA Specific Note "B".
