- In accordance with Section 3.2.1.3.12 of the Federal Aviation Administration Acquisition Management System (FAA AMS), industry is hereby informed that the FAA has a potential maximum five-year contract requirement estimated at $15,000,000.00 over the life of the contract and is seeking information on potential bidders. This procurement is planned to replace an existing contract with NOBLIS. BACKGROUND: The Federal Aviation Administration Technical Operations Directorate, AJW-5 has a requirement for a Contractor that will provide support services with institutional characteristics as a not-for-profit, non-commercial firm chartered to perform in the public's interest as a neutral, independent, objective and free from conflict entity. This requirement entails assisting the FAA with continuing to improve its current operations in the delivery of FAA ATC Communications Services, specifically for telecommunication services, data communications, information technology services, and other related activities. In the prior contract, the FAA has used a not-for-profit contractor to develop cost models for FAA Telecommunication Services, provide specialized subject matter expertise in the area of telecommunication service pricing, provide acquisition support, pricing and program management support to the FAA Telecommunication Infrastructure (FTI) program. PURPOSE: This market survey is to provide information for the FAA to consider in choosing the method and type of procurement competition - full and open; limited; or sole source. SCOPE OF WORK AND CAPABILITIES: A. If awarded, this contract will provide the following technical support services to the Technical Operations Directorate: 1. Economic, Financial and Budgetary Support 2. Customer Pricing and Cost Recovery 3. Transition and Emerging Requirements Support 4. Provide subject matter expertise in the area of telecommunications 5. Business Process Support 6. Electronic Contract Support 7. Acquisition Support 8. Program Management Support 9. Telecommunications Performance Support 10. FS-21 Program Transition Support B. The offeror selected to provide these services must substantiate and demonstrate that they have the following: 1. Prior experience in providing independent, impartial objective advisory services to the FAA specifically in FAA communication programs. The Contractor cannot have any vested interest in any ultimate technology solutions adopted by the FAA. NOTE: Winning bidder will not compete as a prime or subcontractor for any contract other than support/advisory services. 2. In-depth knowledge of the telecommunications environment. This includes business conditions, pricing, other government contracts, and market strategies. 3. In-depth knowledge of the FAA's Telecommunication Infrastructure (FTI) contract pricing structure. The Contractor will support the FAA in the evaluation, negotiation and administration of all aspects of telecommunication services. 4. In-depth understanding of the FTI Business Case including: FTI program budget and legacy system telecommunication budgets. 5. Capability to seamlessly use all tools and processes developed in support of the FTI project as well as all telecommunication legacy contracts. 6. In-depth knowledge of FS-21 program technical requirements including but not limited to: the interfaces with NAS facilities, testing and program scheduling. The Contractor will seamlessly support the ongoing efforts. 7. No less than five years experience with FAA telecommunications and NAS services. 8. Proven ability to work cooperatively with telecommunications service vendor and obtain access to proprietary information needed to accomplish tasks under this contract. C. Firms must also provide clear evidence to support the following: 1. Present capability to provide the required services. Present capability includes: Experienced and qualified staff members (presently on staff or under binding contract) who are able to immediately support the full Scope of Work and Capabilities, and 2. Financial ability to cover payroll and other operating and administrative expenses to accommodate Government "in arrears" payments for work performed for periods up to ninety days. 3. An existing line of credit of $10 million; 4. Recent and extensive experience in contracting with the Federal Government, preferably with the FAA. Experience prior to March 1, 2002 will not be considered recent; 5. A Defense Contract Audit Agency (DCAA)-approved accounting system. 6. DCAA approved rates for all available direct labor categories during fiscal year 2005 along with associated indirect overhead rates (General & Administrative, Fringe Benefits, etc.); 7. An established office within a 25 mile radius of FAA Headquarters at 800 Independence Ave. S.W., Washington DC 20591. REQUIRED AGREEMENTS: The selected contractor will be required to sign an agreement that addresses the organization's legal commitment as described below: A. In the event that the FAA decides to obtain these requirements via procurement, for an offeror's proposal to be considered as responsive, the offeror will be required to submit a signed agreement addressing each of the following three issues (specific wording to be provided by the FAA): 1. That neither the offeror, nor their parent or subsidiary organizations, will be a competitor for any future contract involving any of the technologies and/or equipment that the contractor will be involved in supporting during this contract. 2. That the FAA will retain all intellectual property rights to any and all technologies, concepts, and data developed under this contract. This statement will preclude the contractor from using proprietary information/data as part of their work effort and then claiming any ownership of the product(s)/deliverable(s)/idea(s) they are paid, partially or entirely, to analyze, test, develop, or refine under contract to the FAA. 3. That neither they, nor their parent or subsidiary organizations, will file for patent(s) for anything that they work on under this contract. B. In responding to this market survey, interested parties must specifically state that, if offered an opportunity to bid on a resulting contract, they will sign an agreement on the three issues discussed above. If interested parties do not submit such a statement, their response to this market survey will be regarded as unresponsive and will not be considered. MANDATORY REQUIREMENTS FOR EXPRESSIONS OF INTEREST: In order to be considered responsive, organizations expressing interest in this matter must provide clear evidence showing: 1. Demonstrable, direct, and recent experience and capabilities in the areas listed above under SCOPE OF WORK AND CAPABILITIES (Sections A, B, and C). Responses containing only company brochures, catalogs, or other types of generic information will not be considered. For the above requirements, all experience indicated must include: (a) Description of work performed; (b) Contract number; (c) Identification of the government or commercial entity for whom work was performed (identify all work performed as a subcontractor); (d) Name, title, and telephone number of the Government Contracting Officer and the Government Technical Representative (or equivalent points of contact, for non-government experience); and (e) Information sufficient to enable FAA to contact the respondent, including name, title, address, and telephone number of an authorized representative of the respondent. 2. If offered an opportunity to bid on this contract, they would sign an agreement on the three issues discussed in REQUIRED AGREEMENTS, paragraph A. SUBMISSION FORMAT: Sources capable of satisfying this requirement should submit Capabilities Statements as follows. Unresponsive submissions will not be considered. Chapter 1. SCOPE OF PRIOR WORK. Provide a very concise description of the work the organization has previously done in each of the ten areas described in Section A, SCOPE OF WORK AND CAPABILITIES, of this announcement. Chapter 2. TECHNICAL QUALIFICATIONS AND CAPABILITIES. Provide a description of the organization's qualifications and capabilities in each of the eight areas described in Section B, SCOPE OF WORK AND CAPABILITIES, of this announcement. Chapter 3. BUSINESS QUALIFICATIONS AND CAPABILITIES. Provide a description of the organization's qualifications and capabilities in each of the seven areas described in Section C, SCOPE OF WORK AND CAPABILITIES, of this announcement. Chapter 4. REQUIRED AGREEMENTS. Interested parties must specifically state that, if they were offered an opportunity to bid on this contract, they would be willing to sign an agreement on the three issues discussed in Sections A, REQUIRED AGREEMENTS.
