- This is a combined synopsis/solicitation for a commercial item/service prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Specific documentation is being requested for the Government???s assessment of vendor capability to satisfy ozone depleting chemical removal services. This is not to be construed as a commitment by the Government. All information is to be submitted at no cost to the Government. BPA???s will be issued in advance of actual requirements in order to set forth the terms and conditions that will be applicable to purchases made under each BPA, aka ???Calls.??? Upon issuance of a BPA, the Government will be obligated only to the extent of authorized purchases actually made under the BPA. Each established BPA will be for a duration of five years, subsequent to review at least annually and updated, if necessary, at that time. Competition for individual calls may be limited to BPA???s established subsequent to this announcement, if deemed by the Contracting Officer to represent the maximum practicable competition. The SOW is available for downloading at the website for the issuing office http://procnet.pica.army.mil, also referred to as Procnet. This solicitation is issued as Request for Quotation No. W15QKN-07-A-0078. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-06. FACs issued prior to award will be incorporated in awards resulting from this solicitation. The price list available for downloading at https://procnet.pica.army.mil must be completed and submitted as part of the quotation. The U.S. Army ARDEC, Picatinny Arsenal, New Jersey has a requirement to procure contractor services under one or more Blanket Purchase Agreements (BPA) for ozone-depleting chemical removal services. The contractor(s) shall provide all labor, supervision, travel, materials and equipment, unless otherwise indicated in the specifications, to remove Freon from retired equipment, as identified by the government. For the performance of this action, the contractor shall employ only U.S. Citizens or non-U.S. citizens residing in the United States who legally entered into the United States and can produce evidence of legal authority to be employed in the United States. The provision at FAR 52.212-1, Instructions to Offerors--Commercial, applies to this acquisition, except that the words ???offer??? and ???offeror??? are revised to read ???quotation??? and ???respondent.??? The Government may award one or more BPAs resulting from this solicitation to the responsible vendor(s) whose quotations conforming to this solicitation will be most advantageous to the Government, considering price and other factors related to price (e.g., discount terms). A blanket purchase agreement is not a contract. Under any resultant BPA, the Government will be obligated only to the extent of authorized purchases actually made under the BPA. Individual firm-fixed-price purchases or ???calls??? may range from less than $1 to $25,000 paid via Government credit card and not to exceed $100,000 per call. Term of service and delivery dates as applicable will be as stated in each call. The agreed-to prices for each awarded BPA will be included in the BPA as an attached price list. The price list shall be used as a standing price quotation for at least one year from the effective (issue) date of the BPA in accordance with FAR 13.103. Calls for all services under the BPA(s) shall be based upon the loaded hourly rate in the price list being quantified, plus ancillary costs. All calls under the BPA(s) will be issued in writing. Calls for services above $2,500 will be competed in accordance with FAR Part 12 and 13 at prices to be determined through competitive procurement procedures. Under FAR 13.303-6, BPAs will be reviewed at least annually and, if necessary, updated at that time. The Government reserves the right to make no awards resulting from this solicitation. The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and any agreed upon addenda to the clause will be incorporated in the BPA. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition and the following additional FAR clauses cited in the clause are applicable: 52.219-8, Utilization of Small Business Concerns (MAY 2004) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. 52.222-26, Equal Opportunity (Apr 2002) (E.O. 11246). 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001) (38 U.S.C. 4212). 52.222-36, Affirmative Action for Workers with Disabilities (Jun 1998) (29 U.S.C. 793). 52.222-39, Notification of Employee Rights Concerning Payment of Union Dues or Fees (DEC 2004) (E.O. 13201). 52.222-41, Service Contract Act of 1965, as Amended (JUL 2005), flow down required for all subcontracts subject to the Service Contract Act of 1965 (41 U.S.C. 351, et seq.). 52.247-64, Preference for Privately Owned U.S.-Flag Commercial Vessels (Apr 2003) (46 U.S.C. Appx 1241 and 10 U.S.C. 2631). Flow down required in accordance with paragraph (d) of FAR clause 52.247-64. One or more site visits will be conducted after establishment of BPA???s and prior to issuance of a call, at the Government's discretion. Each BPA will include as a minimum, terms and conditions mandated by Federal Acquisition Regulations (FAR) and the Department of Defense FAR Supplement (DFARS) for commercial item acquisitions, set aside for small business firms, including the following: FAR 52.219-6, Notice of Total Small Business Set-Aside, FAR 52.22-3 Convict Labor (E.O. 11755); FAR 52.222-21, Prohibition of Segregated Facilities; FAR 52.222-26, Equal Opportunity (E.O. 11246); FAR 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era and other Eligible Veterans (38 U.S.C. 4212); FAR 52.222-36 Affirmative Action for Workers with Disabilities (29 U.S.C. 793); FAR 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (38 U.S.C. 4212); FAR 52.232-33, Payment by Electronic Funds Transfer. To be considered for a BPA, vendors must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, available for downloading at Procnet, as well as local clause ARDEC 68 and be registered in the Central Contractor Registry (CCR). Vendors must be willing to comply with the following: a. Register online at http://www.bpn.gov/. Registration is particularly important for Electronic Funds Transfer payment purposes. Additional information is available at the website. b. Submit payment requests in electronic form as required by the DFARS clause 252.232-7003, except for individual cases where--(i) The contractor is unable to submit, or DoD is unable to receive, a payment request in electronic form; and (ii) The contracting officer, the payment office, the contract administration office, and the contractor mutually agree to an alternative method. Payment by credit card may also be authorized for calls not exceeding $25,000. Please indicate accpetance of credit card payment in the request for quotation. c. Comply with the requirements of the ARDEC 68 clause, which is available for review and downloading at Procnet. If interested, submit proof of license issued by the Environmental Protection Agency (EPA) or applicable state environmental regulatory agency to perform the removal of ozone depleting chemicals for Government personnel to assess your capability to satisfy its ozone depleting chemical removal requirements; any discount terms offered; a copy of any terms and conditions customarily included in your commercial contracts to include any express warranty. In addition, provide your company name and address, point of contact with telephone number and email address, and size of business. BPA???s may be issued based on this synopsis/solicitation or from other sources without further announcement or solicitation. Resultant BPA???s will be subject to the Service Contract Act. Wage Determination No. 05-2353, Revision 02, 1 March 2007, is applicable. Future revisions will be incorporated if and when required.
