Description
The National Cancer Institute (NCI), Center for Cancer Research (CCR), Pediatric Oncology Branch (POB), Pharmacology and Experimental Therapeutics (PET) plans to enter into a sole source procurement for SpectraMax M5 Multi-Detection Microplate Reader from Molecular Devices, 1311 Orleans Drive, Sunnyvale, CA 94089. The North American Industry Classification System Code is 334516 and the business size standard is 500 employees. This acquisition will be processed under FAR Part 12 ? Acquisition for Commercial Items and will be made pursuant to the authority in FAR 13.5 to use simplified procedures for commercial acquisitions. Molecular Devices is the only source known to the NCI researcher that has a multi-detection microplate which will meet their research needs as detailed. However, if any interested party believes it can perform the requirement as detailed they may submit a statement of capabilities. The statement of capabilities and any other furnished information must be in writing and must contain material in sufficient detail to allow the NCI researcher to determine if the party can perform this requirement. An original and one copy of the capability statement must be received in the contracting office by 11:00 am EDT, on July 3, 2007. Faxed and emailed capability statements are NOT authorized. It is the vendor?s responsibility to call (301) 402-4509 and verify that questions were received. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Part I: Background information and Description of Acquisition Title: Molecular Devices SpectraMax M5 Multi-Detection Microplate Reader Purpose/Brief History: The research mission of Pharmacology and Experimental Therapeutics (PET) section of the Pediatric Oncology Branch (POB), NCI is to improve the efficacy and safety of therapy for childhood cancers through the clinical development of new drugs and studying the clinical pharmacology of anticancer drugs in children. The PET section has a comprehensive and integrated preclinical and clinical pediatric drug development and clinical pharmacology program. The PET section has extensive experience in designing, conducting and analyzing phase I and II clinical trials in children with recurrent or refractory cancers. Trials incorporate pharmacokinetic and pharmacodynamic correlative endpoints in selecting the optimum dose, assessing the activity of the drug and comparing the clinical pharmacology of the agent to adults. These studies are dependent on the ability of the lab to accurately and sensitively quantify the concentration of the drugs and their metabolites in biologic matrices including plasma and cerebrospinal fluid. PART II: Facts and reasons to Justify Other than Full and Open Competition Statutory authority FAR 13.106(b)(1) b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). (2) For sole source acquisitions of commercial items in excess of the simplified acquisition threshold conducted pursuant to subpart 13.5, the requirements at 13.501(a) apply. Justification: The technology for sensitively and accurately quantifying drug concentrations has advanced dramatically over the past 2 decades. The sensitivity of the microplate readers has improved greatly in the past 10 years. SpectraMax M5 is the only plate reader that is a spectrophotometer, absorbance and fluorescence detector which does the work of 3 detectors. It eliminates the purchase of costly filters with its dual monochromators to determine optimal excitation and emission settings. This plate reader can be used for 96 well and 384 plates simultaneously to determine the end point, kinetic, and spectra. In addition this instrument?s software is compatible with the existing Mac computers. This instrument is needed for the continuation of the ongoing and recently opened clinical trials of the POB, PET section (more than 25 trials) as well as the Neuro Oncology Branch (NOB).
