- The Transportation Security Administration/Office of Law Enforcement/Federal Air Marshal Service (FAMS) intends to negotiate on a sole source basis and award a commercial services contract to LiveTV, 1333 Gateway Drive, Suite 1007, Melbourne, Florida, 32901. The purpose of the contract will be to rapidly demonstrate, in an operational environment, the ability of the FAMS to use a narrowband air-to-ground communications system operating in the 800MHz spectrum designated for air-to-ground communications. This demonstration will entail FAMS ability to use Wi-Fi-enabled personal electronic devices for bidirectional, air-to-ground and intra-cabin, real time email and text messaging during all phases of flight. The demonstration will incorporate FAMS security requirements and will allow access to FAMS enterprise e-mail and text messaging systems. Additionally, the demonstration will provide the FAMS with priority service and/or the ability to preempt other commercial users of the system in case of emergency. In the future, the FAMS may also be interested in a similar demonstration, with expanded service capabilities, using a broadband air-to-ground communications system operating in the 800MHz spectrum. This procurement will be conducted under the authority of TSA's Acquisition Management System, Section 3.2.2.4 - Single Source Selection. The applicable NAICS Code is 54151. Air-to-ground communications capabilities must be demonstrated within 1 MHz of spectrum within the 800 MHz band allocated by the FCC for air-to-ground wireless communications. This spectrum is currently licensed to LiveTV, and LiveTV will be demonstrating the identified capabilities using a proprietary air-to-ground communications system installed on revenue-generating aircraft. This notice of intent is not a request for competitive quotations, as no solicitation document is available. However, any firm that believes it can meet these requirements may give notification via email to the Contracting Officer not later than July 3, 2007. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirement. Information can be sent to the Contracting Officer, FAMS, via email to debra.stuart@dhs.gov and nancy.ballay@dhs.gov. Responses received will be evaluated, however, a determination by the Government not to compete the proposed procurement based on responses to this notice is soley within the discretion of the Government. If no responses are received the FAMS will proceed with a sole-source negotiation with LiveTv.
