- SOURCES SOUGHT NOTICE. This is not a request for competitive quotes and no solicitation is available. The Economic Research Service (ERS or Agency) is an agency within the U.S. Department of Agriculture (USDA). The Economic Research Service is a primary source of economic information and research in the U.S. Department of Agriculture. With 450 employees, ERS conducts a research program to inform public and private decision-making on economic and policy issues involving food, farming, natural resources, and rural development. This ?Sources Sought? notice is being published to determine the availability of small businesses capable of providing legal and litigation support services in the Washington, DC metropolitan area for all internal labor and employment matters relating to agency employees. Qualified small businesses must have experience in both providing legal services to an agency or institution whose primary responsibilities include the conduct of original research and in litigating cases before the Equal Employment Opportunity Commission and the Merit Systems Protection Board. Potential requirements may include but are not limited to: Litigating cases before the Equal Employment Opportunity Commission and Merit Systems Protection Board. Informal consultation with ERS management on labor/employment issues; advice and guidance on labor/employment issues; and representation of ERS on all labor/employment matters raised before a third party. Following procedures as related to the proper application of all governmental privileges as they apply to attorney-client, attorney work-product, law enforcement, and deliberative process and privilege. Following all rules of discovery based on Federal rules of civil procedure. All interested parties are invited to submit a capabilities statement, not to exceed five (5) pages, to be delivered to Mr. Brandon Levin, Contract Specialist. Electronic copies of capability statements are only being accepted and must be emailed to Brandon.Levin@ars.usda.gov .
