Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The Solicitation Number is LDQ000263 and is issued as a Request for Proposal (RFP). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-18. (iv) This requirement is a total set-aside for small business and the associated NAICS code is 511210 and the small business size standard is $23 million. (v) Contract Line Item Number (CLIN) 001 - EVOWARE Standard Software Upgrade, Quantity: 5 each; CLIN 002 - EVOWARE Plus Software Upgrade, Quantity: 3 each; and CLIN 003 - Shipping Charges (if applicable), Quantity: 1 Total Charge. (vi) The Federal Bureau of Investigation (FBI) intends to negotiate on a sole-source basis for the purchase of the software upgrades listed above. (vii) The software shall be delivered to the FBI within 60 days of receipt of a purchase order. Delivery shall be F.O.B. Destination. (viii) The provision at Federal Acquisition Regulation (FAR) 52.212-1, Instructions to Offerors - Commercial (SEPT 2006), applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (JAN 1999), applies to this acquisition. Addenda: (a) The following factors shall be used to evaluate offers: price; technical acceptability, and past performance. The relative order of importance of the evaluation factors in descending order of importance is: price, technical acceptability, and past performance. (x) A completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (NOV 2006), shall be submitted with the offer. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (FEB 2007), applies to this acquisition. Addenda: The following additional clauses apply to this acquisition: FAR 52.224-1, Privacy Act Notification and FAR 52.224-2, Privacy Act. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (JUNE 2007), as well as the following FAR clauses cited in the clause, apply to this acquisition: (5)(i) 52.219-6, Notice of Total Small Business Set-Aside (JUNE 2003) (15 U.S.C. 644); (17) 52.222-19, Child Labor - Cooperation with Authorities and Remedies (JAN 2006) (E.O. 13126); (21) 52.222-36, Affirmative Action for Workers with Disabilities (JUN 1998) (29 U.S.C. 793); (25) 52.225-1, Buy American Act - Supplies (JUNE 2003) (41 U.S.C. 10a-10d); (33) 52.232-33, Payment by Electronic Funds Transfer - Central Contractor Registration (OCT 2003) (31 U.S.C. 3332); and (36) 52.239-1, Privacy or Security Safeguards (AUG 1996) (5 U.S.C. 552a). (xiii) No additional contract requirements or terms and conditions have been determined by the Contracting Officer to be necessary for this acquisition. (xiv) This acquisition is not applicable to the Defense Priorities and Allocations System (DPAS). (xv) Numbered Notes 1 and 22 are applicable to this acquisition. (xvi) Offers are due by 4 p.m. EDS time, July 24, 2007, and shall be submitted to the FBI, Attention: Susan J. Smith, Information Technology Contracts Unit, Module E-3, 1000 Custer Hollow Road, Clarksburg, WV 26306; susmith@leo.gov; facsimile number (304) 625-5391. Proposals shall include documentation to indicate that offeror is able to supply the EVOWARE software upgrades, the cost for each of the CLINS listed above; and three references for past performance. The past performance information shall include those customers to which the same or similar software was sold; a point of contact; address; phone number; and e-mail address. Offeror shall also include a completed copy of FAR 52.212-3 with the proposal. All questions and proposals shall be submitted electronically to susmith@leo.gov.
