- The following questions have been raised by a potential offeror. In an effort to insure that all potential offerors have the same information from the Government, responses to the potential offeror's are provided herewith: Question #1: How does an interested prospective offeror acquire the TDP to be in compliance with the listed specifications for the M16A4? Government Answer: At solicitation issue, every interested prospective offeror will be directed to submit a pair of Non-Disclosure Agreements, as the end item is subject to proprietary licensing agreements between the US Government and two suppliers. Once I receive properly completed Non-Disclosure Statements endorsed by a representative authorized to bind prospective offerors, I will direct that the Technical Data Package (TDP) be sent on CD-Rom via surface mail. If a potential offeror desires to have the mailing of this T DP expedited, potential offerors should include their FEDEX Account # when submitting a properly completed Non-Disclosure statement(s). Question #2: Are there any deviations permitted to the specs? Government Answer: No. Every offeror must quote to the Government specification(s) as published. Potential offerors cannot quote assuming that the Government would approve of any request for deviation (RFD) as submitted by an offeror. During the open solicitation period, engineering questions raised by potential offerors are encouraged and will be published as Questions and Answers in the form of material amendments to the solicitation. This process alerts ALL potential offerors to information that could affect how a pote ntial offeror responds to both non-price and pricing-related solicitation requirements. However, if an offeror becomes a subsequent awardee and then finds the necessity to submit a Request for Deviation following award, there is a method in place to support that process. Question #3: The solicitation release date has been modified to July 31, 2007. Is this the date when we may begin to send the necessary documentation for this solicitation? Government Answer: The solicitation release date as announced on FedBizOpps is an ESTIMATED release date. If you have already activated the automatic email notification that FedBizOpps allows in connection with any solicitation, you will receive automatic notification of th e solicitation release. The Government does not maintain an interested bidder list, and it is incumbent on industry to monitor our Open Solicitation website for the actual publication of the solicitation. On issue, potential offerors may download the solicitation and its associated attachments. It is at that point that potential offerors can submit their properly completed Non-Disclosure Statements (see Question/Answer #1). Question #4: When does the solicitation close? Government Answer: The solicitation will carry a clear closing date when issued. That date will be NO LESS than thirty days from the original issue date. Potential offerors are strongly encouraged to continuously monitor our Open Solicitation website for material amendment s that may be published while the solicitation is open for industry response. Some of these amendments may extend the original closing date. NOTE 2 applies.
