Description
DESCRIPTION: The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Semiconductor Electronics Division, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Oerlikon USA, Inc., St. Petersburg, FL, for the purchase of an Optical Emissions Spectrum component. Sole Source determination is based on the following: NIST currently utilizes a Nanofabrication tool from Oerlikon. NIST requires an upgrade of an Optical Emission Spectrum (OES) component. This OES system is required to determine the endpoint of an etch process. With an OES upgrade, the time a user spends developing an etch recipe will be greatly reduced, and will automatically end the etch process when the stop layer is reached. The OES system is a third party component but must be selected and installed by Oerlikon for compatibility. Oerlikon is required to provide software that will integrate with the current system software so that the upgrade will function with the existing system as a whole. In addition, modifications must be made to the existing tool reactor lid to accommodate the required OES system. Based on the complexity of the equipment involved, all work for this upgrade should be conducted by the tool manufacturer. Therefore, the upgrade must be 100 percent compatible with the existing Nanofabrication tool. Oerlikon is the manufacturer and distributor of the existing Nanofabrication tool, and the distributor of the OES system upgrade that is required to satisfy the Government?s minimum requirements. The North American Industry Classification System (NAICS) code for this acquisition is 333295, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by August 9, 2007, 3:30 p.m. EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
