Description
INTENT TO AWARD A SOLE SOURCE PROCUREMENT. The U.S. Air Force Global Positioning Systems Wing (GPSW) intends to procure one memory instance license for a 0.13 Micron embeddable reprogrammable non-volatile memory to be used in production of Global Positioning System (GPS) security devices at the IBM trusted foundry. Accordingly, the Government intends to award a sole-source contract to Virage Logic (size standard 500), 47100 Bayside Parkway Fremont, CA 94538 as the only responsible source that can provide those supplies and services without the Government incurring substantial duplication of cost that are not expected to be recovered through competition and/or unacceptable delays in fulfilling its requirements. (10 U.S.C. ? 2304(c)(1)). In 2004, the GPS Cryptography Key Data Processor (KDP) Program was required to be fabricated at the NSA?s Trusted Foundry, which IBM was selected for. Virage Logic is the only memory maker with embeddable reprogrammable non-volatile memory at IBM at 0.18 Micron or smaller, and also having qualified memories at 0.13 and 0.09 Micron. Due to the circumstances described herein, this activity will issue a new Fixed Price contract for the acquisition of embedded non-volatile reprogrammable memory intellectual property. The authority for this sole source acquisition is ?6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements? as further defined in FAR 6.302-1(a)(2)(iii)(B), ??when it is likely that award to any other source would result in unacceptable delays in fulfilling agency?s requirements.? An ombudsman has been appointed to hear concerns from potential offerors. The purpose of the ombudsman is to receive and communicate concerns from potential offerors when an offeror prefers not to use established channels to communicate its concern during the proposal development phase of this acquisition. The ombudsman will communicate certain offeror issues, disagreements, and recommendations on this acquisition to the proper channels. The ombudsman's role is not to diminish the authority of the program director or the contracting officer but to advocate an offeror's concern on a non-attribution basis. The ombudsman will maintain strict confidentiality as to the source of the concern when requested by the offeror. The ombudsman is Mr. James Gill, Phone Number (310) 653-1789.
