- Department of Labor, Office of the Assistant Secretary for Administration and Management, Procurement Services Center, S-4306 200 Constitution Avenue, NW, Washington, DC, 20210-0001, The Department of Labor(DOL) Office of Procurement Services (Civil Rights Center) intends to acquire Professional Development Services for the National Equal Opportunity Professional Development Forum scheduled for September 2007. This requirement is restricted to GSA Schedule Holders (Small Business Only). Quotes are accepted only by e-mail:ickens.Patrice@dol.gov and/or facsimile machine at (202) 693-4579 NO LATER THAN JUNE 6, 2007, 12:00 NOON. All prospective offerors must be registered in the Central Contractor Registration (CCR) Database. Offerers shall submit quotation separating labor costs from other direct costs. Quotations should also include a line for total amount. STATEMENT OF WORK OASAM/Civil Rights Center I.TITLE: Equal opportunity professional development services for external stakeholders and CRC staff relative to DOL financially assisted and conducted programs. II.BACKGROUND: The Civil Rights Center (CRC) is the only entity within the Department of Labor that enforces various Federal statutes and regulations that prohibit discrimination in DOL financially assisted and conducted programs and activities. One of the CRCs primary goals is to make sure that its customers, the recipients of DOL financial assistance and DOL program agencies, have the essential information, materials, and training that will enable them to adequately comply with Federal equal opportunity and nondiscrimination laws and regulations. The CRC develops, administers, and enforces Departmental policies, practices, and procedures under Title VI and Title VII of the Civil Rights Act of 1964; Section 188 of WIA; the Rehabilitation Act of 1973; the Age Discrimination Act of 1975; the Equal Pay Act; Title IX of the Education Amendments of 1972; Title II of the Americans with Disabilities Act, Secretary's Order 4-2000 and related statutes and Executive Orders which prohibit discrimination in programs and activities receiving Federal financial assistance. III.OBJECTIVES: To make certain that the Civil Rights Center has the tools and knowledge to be able to continue to ensure nondiscrimination and equal opportunity in programs that receive Federal financial assistance from the DOL and DOL conducted programs at a time when that knowledge has been steadily depleted due to attrition, it is essential that the Center not only be able to continue to provide essential training and assistance to stakeholders in the short term, but also begin to equip current staff with the knowledge and tools that will ensure success long-term. IV.SCOPE: The nature of the work includes the following, which shall be specifically geared towards the CRCs program of ensuring nondiscrimination and equal opportunity within programs that receive financial assistance from DOL and DOL conducted programs: content development and planning for the CRCs professional development forum; complaint investigative training curriculum development and execution for the CRCs recipient community; and development and documentation of CRC procedures for complaint investigations and compliance reviews of DOL financial assistance recipients. V.PERFORMANCE REQUIREMENTS. TASK1: CRCs NATIONAL EQUAL OPPORTUNITY PROFESSIONAL DEVELOPMENT FORUM. CRCs National Equal Opportunity Professional Development Forum represents the Department positive efforts to provide compliance assistance to secure voluntary compliance with civil rights laws from DOL financial assistance recipients. The conference is a significant learning experience, and represents the Department commitment to assisting its grantees and federally conducted program contractors fulfill their equal opportunity and nondiscrimination obligations. Each year, the conference is attended by workforce system professionals that represent workforce programs at the national, State and local levels and include Job Corps, Employment Services, Unemployment Insurance Services, Migrant and Seasonal Farm workers programs, Indian and Native Americans programs, Older Workers programs, and Workforce Investment Act (WIA) programs. The Forum covers a broad range of current civil rights issues uniquely suited to helping equal opportunity professionals in the workforce system maintain their competencies and better equip them to administer effective equal opportunity programs. The Forum includes offerings that deal with all of the laws applicable to U.S. Department of Labor financial assistance recipients. The Contractor shall provide planning and workshop development for the National Equal Opportunity Professional Development Forum scheduled for September 2007. This project will involve the following primary tasks: Conference Theme: Selection of a theme that will be the main learning objective for the conference. Plenary Sessions: Development of opening and closing plenary sessions that feature speakers that are national leaders in the field of civil rights. Workshops: Creation of as many as 32 90-minute workshops that bring engaging, practical learning experiences. The workshops are to employ various modes of engagement and incorporate effective adult teaching techniques and provide the opportunity for participants to enhance their knowledge of civil rights issues/requirements, communicate ideas, and share best practices. The workshop offerings are to be designed to meet the needs of state and local level recipient staff who have responsibility for administering equal opportunity programs that are part of programs receiving financial assistance from DOL Employment and Training Administration, Office of Job Corps, and Veterans Employment and Training Services. Conference Program and Registration Brochure: Provision of content for the development of the conference program booklet and registration brochure. The following deliverables shall be developed: Conference Work Timeline: Timeline illustration for the planning of the Forum. Conference Budget Form: Detailed listing by expense group and object class of the Forum budget plan. Speaker/Workshop Presenters Confirmation: The contractor will obtain workshop and plenary speakers/presenters. Standard letters will be developed for CRC use in confirming agreements and arrangements with speakers and workshop presenters. Speaker Tracking Chart: A table that illustrates, for each speaker, the amount of any honorarium to be paid, transportation being provided to get to and from the conference, and special equipment needs for the presentation. Conference Notebook Checklist: Compilation of all of the information that the Conference Coordinator will need to have available at the conference each day to ensure successful execution of planned activities. This checklist will prepare the Conference Coordinator to handle any question with ease, to know each workshop presenter and location, and to know where a speaker will sit at plenary sessions and lunches. TASK 2: COMPLAINT INVESTIGATIVE TECHNIQUES TRAINING. The contractor shall develop and execute a 12-16 hour compliant investigative techniques training that will be geared towards enhancing the knowledge and skills of DOL financial assistance recipient Equal Opportunity Officers in receiving, reviewing, and investigating discrimination complaints. The course will be designed to improve the day-to-day capability of those with responsibility for handling discrimination complaints. The schedule and specific content of the training will be developed through conversation between the contractor and the CRC. However, the workshop will mix lecture with hands-on practice and will include the following subjects as they relate to DOL non-discrimination/equal opportunity regulations: Distinguishing between program and discrimination complaints; Role and responsibility of the Equal Opportunity Officer in investigating discrimination complaints; Legal theories of discrimination; Receiving and reviewing complaints; Accepting and dismissing claims; Planning the complaint investigation; Analyzing evidence Maintaining confidentiality and privacy considerations; and Legal elements of proof. TASK 3: COMPLAINT INVESTIGATIVE MANUAL. The contractor shall develop a complaint investigative manual or handbook that provides guidance on the investigation of discrimination complaints against DOL Federal financial assistance recipients. The manual will offer guidance to CRC Equal Opportunity Specialists through each step of the complaint process with helpful pointers, reference materials, and full instruction on standard operating procedure requirements. Specific content of the manual will be developed through conversation between the contractor and the CRC. TASK 4: COMPLIANCE REVIEW HANDBOOK. The contractor shall develop a handbook that provides guidance on how to plan and conduct structured review of a DOL Federal financial assistance recipient. The handbook would cover both distant and onsite reviews and provide detailed instructions on required internal procedures. The handbook would offer guidance to CRC Equal Opportunity Specialists in defining the purpose and scope of a review each step of the review. Specific content of the handbook will be developed through conversation between the contractor and the CRC. VI.REQUIRED TECHNICAL QUALIFICATIONS/EXPERIENCE A.Detailed knowledge of and experience with implementing the provisions of the following statutes and associated regulations: Title VI and Title VII of the Civil Rights Act of 1964 Section 188 of WIA; the Rehabilitation Act of 1973; The Age Discrimination Act of 1975; The Equal Pay Act Title IX of the Education Amendments of 1972; Title II of the Americans with Disabilities Act; Title 28 CFR Part 35. Nondiscrimination on the Basis of Disability in the State and Local Government Services. Title 29 CFR Part 31. Nondiscrimination in Federally-assisted programs of the Department of Labor, effectuation of Title VI of the Civil Rights Act of 1964. Title 29 CFR Part 32. Nondiscrimination on the Basis of Disability in Programs and Activities Receiving or Benefiting from Federal Assistance. Title 29 CFR Part 33. Enforcement of Nondiscrimination on the Basis of Disability in Programs or Activities conducted by the Department of Labor. Title 29 CFR Part 34. Implementation of the Nondiscrimination and Equal Opportunity Requirements of the Job Training Partnership Act of 1982. Title 29 CFR Part 35. Nondiscrimination on the Basis of Age in Programs or Activities Receiving Federal Financial Assistance from the Department of Labor. Title 29 CFR Part 37. Implementation of the Nondiscrimination and Equal Opportunity provisions of the Workforce Investment Act of 1998. Secretary's Order 4-2000 and related statutes and Executive Orders which prohibit discrimination in programs and activities receiving Federal financial assistance B. Detailed knowledge of and experience with the following DOL programs: Workforce Investment Act program, Job Corps program Wagner-Peyser program, Unemployment Insurance program, Senior Community Service program, Indian & Native American program, National Farm worker Jobs program, C. Experience developing and delivering skill-based training content relative to A and B above D. Knowledge of current civil rights issues within the programs listed in B above E. Familiarity with the current EO community of the programs listed in B above F. Knowledge of the larger civil rights community from which resources can be pulled G. Experience in conference planning, content development, and execution for recipients of Federal financial assistance H. Understanding of and experience with equal opportunity compliance reviews and complaint investigations relative to recipients of Federal financial assistance VII. PERIOD OF PERFORMANCE. Date of award through December 31, 2007 VIII. PLACE OF PERFORMANCE. DOL onsite and other locations within the Washington, DC area, as applicable.
