Description

The National Institute of Standards and Technology (NIST), Acquisition Management Division, on behalf of the Biochemical Science Division, intends to negotiate and award a purchase order on a sole source basis under the authority of FAR 13.106(b)(1), with Bruker Biospin Corporation of Billerica, MA for service for an NMR Spectrometer. Sole source determination is based on Bruker Biospin Corporation being the sole manufacturer and sole maintenance provider of the NMR Spectrometer. Therefore, Bruker Biospin Corporation is the only source that can provide preventative maintenance for this equipment, as the technology is proprietary to the company. Bruker Biospin Corporation does not authorize other companies to provide such a service. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by August 16, 2007 will be considered by the Government. A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
