We are herewith providing a public response to those requests, so as to provide the same information to all potential bidders on this project. Note that the submission deadline for this project remains unchanged. <u>The following questions were posed by U.S. bidders and answered by the U.S. Trade and Development Agency:</u> Question (U.S. bidder): Can USTDA's funding cover taxes, tariffs, duties, fees associated with this project? Answer (USTDA): Please refer to Article 12 and Annex II-Clause O of the Grant Agreement, which states: "USTDA funds provided under the Grant Agreement shall not be used to pay any taxes, tariffs, duties, fees or other levies imposed under laws in effect in Host Country. Neither the Grantee nor the Contractor will seek reimbursement from USTDA for such taxes, tariffs, duties, fees or other levies." Question (U.S. bidder): Section 2.10 - Substantive Proposals states the "...Offeror shall certify..." four items. We need to understand what USTDA expects. For example, is a statement included in our RFP response affirming the requested items enough? If not, what is required? Below is the Section we need clarified? Answer (USTDA): In terms of the certification of the following four items detailed in Section 2.10, USTDA will require that your company provide a statement certifying that your company complies with the four statements and, if applicable, provide information to substantiate your certification. The question posed by this U.S. bidder pertains to Section 2.10 of the RFP, titled "Substantive Proposals", which states: "The Offeror shall certify (a) that its proposal is genuine and is not made in the interest of, or on the behalf of, any undisclosed person, firm, or corporation, and is not submitted in conformity with, and agreement of, any undisclosed group, association, organization, or corporation; (b) that it has not directly or indirectly induced or solicited any other Offeror to put in a false proposal; (c) that it has not solicited or induced any other person, firm, or corporation to refrain from submitting a proposal; and (d) that it has not sought by collusion to obtain for himself any advantage over any other Offeror or over the Grantee or USTDA or any employee thereof." Question (U.S. Bidder): Do we send the USTDA copies of our proposal? In your Model Proposal Format US Firms 62805 - Proposal and Budget Model Format Copies: "...A minimum of six copies of the proposal must be submitted to USTDA. In addition, an electronic version (as an e-mail attachment or on a CD) must be provided. If the proposal contains confidential commercial information, it should be so marked..." I know we send to the Grantee an Original and 8 copies (each marked with a unique number: 1-8) and that they must be individually bound and sealed. Answer (USTDA): To answer your question, copies of the proposals for the RFP solicitation should be sent to the Grantee, not USTDA. Note that USTDA can only provide guidance on what has been stated in the RFP. The Grantee will have the ultimate authority in deciding whether your proposal complies with the requirements of this project. <u>Below are questions posed by U.S. bidders and answered by the Grantee (Eznis Airways LLC):</u> Question (U.S. bidder): While we have pretty much finalizing our submission, we would be interested in learning more of the results of 7-8 months of Eznis operations - e.g. loads, yields, financials, operational performance of the Saabs, plus an idea of how advance bookings and forecasts look. Answer (Eznis Airways LLC): This is little bit hard to present at this moment, therefore, we could not provide full statistics Question (U.S. Bidder): It would be interesting to learn how the airline has done in relation to your startup forecasts. And also get your thoughts on what you perceive as your biggest problem(s) and the most positive surprise(s) to date. Answer (Eznis Airways LLC): In line with startup forecast maintenance, cost control, crew, engineering sourcing is hard. The positive side is actually we surprised by real potential of market after observation of few months operation. Question (U.S. Bidder): We are also anxious to learn more of the government's current posture toward de-monopolization of international routes (e.g. authorizing Eznis to compete with MIAT or be awarded sole route authority on some specific routes). Answer (Eznis Airways LLC): We believe Government wants to de-regulate international routes. There is no principal legal barrier exists. Question (U.S. Bidder): Given the lack of progress on privatization, we believe that pressure could be brought to bear on the government to open up the international market - and look forward to working with you on this. Answer (Eznis Airways LLC): Same is we do feel. Question (U.S. Bidder): Can you suggest the best delivery company to use for ensuring that the proposal that will get it to you on time? Answer (Eznis Airways LLC): In Mongolia, there are operating DHL, FedEX and EMS. All is reliable and delivers documents within 3-5 business days. Question (U.S. Bidder): Is an organization chart of the company available with the people are in each department and location? Answer (Eznis Airways LLC): Available, this file is attached to this (email) RFP (Addendum 1b - Eznis Organizational Chart) Question (U.S. Bidder): Have you attempted or are you interested in developing alliances with other airlines? Answer (Eznis Airways LLC): We attempted to establish some time ago. At this stage not yet established any, but in future definitely we would work toward creating an alliances with other airlines. At this stage, we do operate ourselves in domestic market. Question (U.S. Bidder): Are your Global Network Service and Information Technology (IT) sole-sourced to SITA? Answer (Eznis Airways LLC): Not yet. Currently we do bookings manually, starting from September we will use software for seat distribution developed by in house. In general, company is in contact with SITA and preliminary received proposal to adopt SITA in operations. Question (U.S. Bidder): What are your anticipated training needs for: 1. Knowledge about enforcing tariff rules to protect revenue sales 2. Learning performance measurement reporting skills 3. Acquiring the skills to maximize every flight departures revenue? Answer (Eznis Airways LLC): All three aspects are essential in our training needs, more specifically airline is eager to receive training for cost analysis, revenue accounting, yield management, aircraft best utilization. Question (U.S. Bidder): Is it possible to get any financial information? Answer (Eznis Airways LLC): Possible, but need to specify what kind of financial information is looking for. Question (U.S. Bidder): What is the monthly utilization rate for each of the 2 Saab 340s currently in service, and what percent is flown on regularly scheduled routes, and what percent is operated under charter or contract flying? Answer (Eznis Airways LLC): We do have three aircrafts operating at this moment. Flight numbers depends on seasonality of operation. Summer period traffic is high then in winter time. As of figures, percentage of scheduled route flights is 65% and 35% is non-scheduled, charter or contract flights for July 2007. Question (U.S. Bidder): With respect to the proposed helicopter services, have you been approached by mine exploration companies and others who would go to contract if the machines were available, or does the level of potential demand for this service also need to be researched as part of our efforts? Answer (Eznis Airways LLC): Demand of helicopter service by mining companies is high. We do not have specific search or requirements yet, but during the meeting with mining companies executives, there are strong request on using helicopters for their operation. We do prefer as part of research include helicopter use demand among mining companies.
