Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is LDQ000613 and is issued as a Request for Proposals (RFP). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Number 2005-19. (iv) This requirement is not a set-aside. (v) Contract Line Item Number (CLIN) 0001: Foray Technologies Performance Series RAID Workstation--Quantity 2; CLIN 0002: Foray Technologies Tape Backup for RAID Workstation--Quantity 1; CLIN 0003: Foray Technologies Authenticated Digital Asset Management System (ADAMS) Software Licenses--Quantity 2; CLIN 0004: Installation Services, Training, and Support Services. (vi) The FBI intends to negotiate on a sole-source basis with Foray Technologies to acquire the above items, which are proprietary to Foray Technologies and provide a secured, multi-tiered digital asset management platform. The equipment, software, and services shall be delivered to Federal Bureau of Investigation Laboratory at 2501 Investigation Parkway, Quantico, Virginia 22135, and shall be F.O.B. Destination. (viii) The provision at FAR 52.212-1, Instructions to Offerors--Commercial Items applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation--Commercial Items applies to this acquisition. Addendum to Paragraph (a): The following factors shall be used to evaluate offers and are in descending order of importance--technical capability of item offered to meet the Government requirement; price; and past performance. (x) Offerors are required to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications--Commercial Items, with its offer. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions--Commercial Items, applies to this acquisition. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items, and the following additional FAR clauses cited in the clause are applicable to this acquisition: (16) 52.222-3, Convict Labor (JUNE 2003) (E.O. 11755); (17) 52.222-19, Child Labor--Cooperation with Authorities and Remedies (JAN 2006) (E.O.13126); (18) 52.222-21, Prohibition of Segregated Facilities (FEB 1999); (19) 52.222-26, Equal Opportunity (MAR 2007) (E.O.11246); (21) 52.222-36, Affirmative Action for Workers with Disabilities (JUN 1998) (29 U.S.C. 793); (28) 52.225-13, Restrictions on Certain Foreign Purchases (FEB 2006) (E.O.s, proclamations, and statutes administered by the Office of Foreign Assets Control of the Department of the Treasury); (33) 52.232-33, Payment by Electronic Funds Transfer--Central Contractor Registration (OCT 2003) (31 U.S.C. 3332); and (36) 52.239-1, Privacy or Security Safeguards (AUG 1996) (5 U.S.C. 552a). (xiii) The following additional clauses are applicable to this acquisition: 52.224-1, Privacy Act Notification, and 52.224-2, Privacy Act. Additionally, for the past performance evaluation, Offeror shall provide three references to include name; agency or commercial customer name; telephone number; and e-mail address for three contracts in which Offeror provided the same or similar equipment and software. (xiv) The Defense Priorities and Allocations System (DPAS) and assigned rating is not applicable to this contract. (xv) Numbered Note 22 applies. (xvi) Offers are due via e-mail at susmith@leo.gov by 5 p.m., September 5, 2007.
