Description
This is a combined synopsis/solicitation for commercial item prepared in accordance with FAR Subpart 12.6. This announcement constitutes the only solicitation; proposals are being requested and a paper solicitation will not be issued. The solicitation number is MCC-07-0169-RFQ-77, and is issued as a request for quotation (RFQ), with incorporated provisions and clauses in effect through Federal Acquisition Circular (FAC) 2005-17. A firm fixed price contract is anticipated. The period of performance is one year with options for four additional years. This requirement is being synopsized under the North American Industry Classification System code 611430 - Professional and Management Development Training, and the size standard is $6.5M. Background: In January 2007, The Millennium Challenge Corporation (MCC) purchased the rights to use the General Conditions of Contract from the Federation Internationale des Ingenieurs-Conseils (FIDIC) in the tendering for infrastructure construction projects as FIDIC is increasingly becoming the industry standard. After the adoption of FIDIC General Conditions by Millennium Challenge Account (MCA) in Vanuatu for the Transport Infrastructure Project, MCC has decided to adopt FIDIC General Conditions as the standard form of contract for MCC infrastructure projects. In May 2007, members of MCC, along with Procurement Directors of various MCA-units received training in the first of four training modules offered by FIDIC, covering practical use of the major works 1999 contracts, for procurement and project administration/management. The Millennium Challenge Corporation intends award with a Contractor to provide this same training in four separate regions (see list of countries, below). More about MCC and the MCA-units can be found at the MCC website, www.mcc.gov. Description: The overall objective of the assignment is to train MCA-unit Infrastructure Directors and staff in the use of the FIDIC General Conditions of Contract and in the best practices of FIDIC owners. Task 1 ? Provide general training in the different clauses of both the Red Book and Yellow Book FIDIC Contracts. Training should cover, introduction & principles, general provisions, responsibilities of the Employer, responsibilities of the Engineer, responsibilities of the Contractor, Nominated Contractors, design (Yellow Book), workmanship, commencement procedure, program, extension of time, suspension, taking over certificate, defects period and performance certificate, measurement, evaluation, variations, payment, termination by Employer, suspension/termination by Contractor, risks and responsibilities, insurance, force majeure, Contractor?s claims, Disputes Adjudication Board, amicable settlement, arbitration, and differenced between the standard FIDIC and MDB Harmonized Construction Contract (Module I of standard FIDIC Training). Task 2 - Be prepared to provide guidance/suggestions to class participants (MCA-Unit counterparts) inquiring about the preparation of the Particular Conditions of Contract for contracts they are preparing for tender. The following items are currently anticipated as two day training sessions for the basic period of the contract: CLIN 0001 ? Training Session in Managua (Nicaragua) CLIN 0002 ? Training Session in Yerevan (Armenia) CLIN 0003 ? Training Session in Accra (Ghana) CLIN 0004 ? Training Session in Maputo (Mozambique) However, this list of items may be revised and/or extended, based on upcoming needs of MCC in such training sessions. Classes are expected to be for 15-30 participants, exact numbers to be confirmed prior to the class dates. MCC will provide classrooms. Contractor will provide instructor time, travel, and accommodations, and course materials, handouts. Courses are expected to be held between mid October and mid December 2007. Exact dates for each session will be agreed upon and confirmed no less than two weeks before the class date. The Government will award a contract resulting from this Solicitation to the responsible offeror whose offer conforming to the Solicitation will be most advantageous to the Government, based on evaluation factors listed below in descending order of importance: A. Technical Capability; and B. Past Performance A. Technical Capability To be considered for this requirement, the offeror MUST meet the following minimum qualifications: 1. Trainer(s) must have related technical background in engineering/project management and be professionally registered for at least 10 years; 2. Trainer(s) must have international project experience for at least 10 years on at least 10 projects; 3. Trainer(s) must have previous experience with training in FIDIC contracts (at least 5 courses, equivalent to Module 1); 4. Trainer(s) must have adequate training materials, including case studies (100 overheads; 50 pages of course notes; 5 case studies; detailed program available); 5. Trainer(s) must be fully aware of recent developments and thus associated with FIDIC or a FIDIC Member Association (member of a FIDIC Committee; member of an Association; Affiliate Member of FIDIC; regular attendance at FIDIC Conference or FIDIC Users Conference). Offerors who are not qualified will NOT be considered further. B. Past Performance The Offeror MUST provide at least one past performance reference for similar contract/order completed within the past 1 year (or which is currently being completed), to include the name of the customer organization, a named point of contact in that organization that is familiar with the contract/order from a technical or contractual standpoint, their phone number, their email address, and their fax number. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all, including sources outside of the Government. NOTE: All quotes MUST include price(s), payment terms, and a point of contact (POC), name and phone number. Each response must clearly indicate the capability of the offeror to meet all specifications and requirements. For the purposes of this Solicitation, price will be evaluated separately. To be eligible for award, offerors must be registered in the Central Contractor Registration (CCR), as required by FAR 52.204-7, Central Contract Registration.
