This synopsis/solicitation is for commercial items prepared in accordance with the format in FAR Subpart 12.603, as supplemented with additional information included in this notice. This announcement constitutes the only notice; a paper solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through the latest posting of the Federal Acquisition Circular as of the announcement. The Federal Trade Commission is looking for a company and/or educational institution to provide a well developed one-day legal writing program with potential follow-up tutorial sessions to be given to its attorneys. We anticipate that this course should be something that is already developed, however could be slightly modified to meet the FTC's needs by virtue of the FTC mission (See http://www.ftc.gov) B.General Course Info: 1.The course will need to be designed to instruct up to fifty participants in a one day classroom environment. 2.One copy of "Thinking Like a Writer. A Lawyer's Guide to Effective Writing and Editing" (2nd Ed. PLI 2003), for office-wide use or equal version of another book. 3.Writing samples from a select group of six to eight of the proposed participants will be sent to the contractor at least 21-days in advance, so the proposed instructor can gear their attention to any specific needs of said student(s) and so that these students can be involved with a "follow-up tutorial" session if requested. 4.Follow-up tutorial sessions for smaller groups (6-8 from the submitted writing samples) may be requested. These sessions shall be via telephone conference call, not in residence. Pricing for these sessions shall be per individual. 5.A 30-day notice to schedule course dates will be given unless the contractor offers less within proposal/quote. 6.Coordination of the actual course dates will be conducted between the training Manager and successful contractor after award. 7.The FTC will guarantee one session for the local location, and two sessions for the regional location identified below but reserve the right to request additional classes if needed within 1-year from date of award. C.Government Provided: The Federal Trade Commission will house and provide the meeting room equipped with overhead projector, screen and public address system for the following locations. Local: HQ FTC, 600 Pennsylvania Ave. NW, Washington DC, 20580 Regional: The locations listed below are subject to hold two (2) sessions each at a different location. At this time the FTC has not yet determined which locations will be used. Please quote so costs are covered for any location(s) selected by the FTC. 1.East Central Region- Cleveland 2.Midwest Region- Chicago 3.Northeast Region- New York 4.Northwest Region- Seattle 5.Southeast Region-Atlanta 6.Southwest Region-Dallas 7.West Region-Los Angeles 8.West Region-San Francisco Contractor Quotes/Responses: A.A contractor must respond to all requested courses (local and regional). B.Each course shall be seperately priced (regional and local) for 50-students, include all costs to cover the stated needs and have its own technical information. C.All quotes shall include information pertaining to each class in the following areas: 1.Written Training curriculum 2.Professional presentation by expert trainer (Send Instructor Resume) 3.Workshop reference materials guide for each participant (50 each) 4.One copy of "Thinking Like a Writer. A Lawyer's Guide to Effective Writing and Editing" (2nd Ed. PLI 2003) or proposed equal book. 5.Pre-workshop assessment of writing samples (6-8 each) 6.Pre-workshop telephone conferences with COTR if needed 7.Post-workshop tutorial sessions (as ordered) 8.Two references that have used this class within last 2-years 9.Fixed price per session (regional and local) 10.Fixed price per student for potential post-tutorial sessions D.Quote/Proposal submission: 1.Courses will be awarded based on the best value continum with technical and all other non-priced factors being considered significantly more important than price, including the agencies determination as to responsiveness and responsibility of the contractor to provide the needed services. 2.The contractor is to submit a quote no later than September 14, 2007, 1 PM (EST) for the above services. 3.The submission can be in the Contractors formatt but it shall include all necessary data to enable a proper evaluation of the course and applicable pricing. 4.Email submission to Bret Zieman, Contracting Officer, bzieman@ftc.gov - It is up to the vendor to confirm email receipt. All future information about this acquisition including solicitation amendments will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. 2.Proposal submission: The FTC will evaluate proposals based on "Best Value" with all technical and other non-price factors considered significantly more important than price. The contractor shall provide a Technical and Price proposal as outlined below. The following provisions and clauses apply to this procurement and are available on www.arnet.gov: Federal Acquisition Regulation (FAR) provision 52.212-1, Instructions to Offeror- Commercial Items (JAN 2006); FAR provision 52.212-2, Evaluation-Commercial Items (SEP 2006).The Government reserves the right to award without discussions; therefore, it is critical that each quote be fully responsive. However, the FTC also reserves the right to conduct discussions, if later determined to be necessary. FAR provision 52.212-3, Offeror Representations and Certification-Commercial Items (NOV 2006) - Please note: All offerors and prospective contractors must supply their Representative and Certification Application (ORCA) data (see website at http://orca.bpn.gov) or provide a completed copy of 52.212-3 along with their quote. FAR Clause 52-212-4, Contract Terms and Conditions- Commercial Items (FEB 2007); FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (JUN 2007 ). Clauses incorporate by reference can be found it at www.arnet.gov. All quotes from responsible sources will be considered. Quotes shall be accepted by email only. See listed points of contact for submission. This contract will be awarded as a commercial item in accordance with Federal Acquisition Regulation Part 13.5 Simplified Acquisition Procedures. All contractors anticipating award must be registered in the Central Contractor Registration Database website.
