Description
This notice of intent will serve as notification of a Sole Source for the following: The Department of Biology (DFB), requests a sole source procurement to renew the maintenance service agreement for the following labatory items: Steam Sterilizer, Animal Cage Washer and Glassware Washer. The only acceptable source for providing this service is Getinge USA Inc, 1777 E. Henrietta Rd, Rocherster NY 14610-3133. Getinge USA, Inc is uniquely qualified to maintain this equipment because they are the sole manufacturer. This will be a firm Fixed Price contract. This Notice of Intent is not a request for competitive proposals. This is a unfunded requirement. This requirement will only be effective if FY08 funds become available. This procurement is for the acquisition of a sole source commercial item using simplified procedures in accordance with FAR Parts 12 & 13. FAR provisions 52.212-3-Offeror Representations and Certifications - Commercial Items and 52.212-4, Contract Terms and Conditions-Commercial Items apply. In addition, the clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items, apply to this acquisition. Additional FAR clauses cited in the clause applicable to this acquisition are: (b) 14, 15, 16, 17, 19, and 31. DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes of Executive Orders applicable to Defense Acquisitions of Commercial Items, applies to this acquisition. The following clause is included as an addendum: Department of Defense FAR Supplement 252.204-7004, Required Central Contractor Registration. You are reminded to refer to FAR 52.212-1, Instructions to Offerors - Commercial Items, regarding Solicitation Amendments. 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. Any responses not received by 14 Sept 2007, at 1200 hours, Mountain Time Zone, to 10th ABW/LGCB, Operational Contracting Office, 8110 Industrial Drive, Suite 200, USAF Academy, CO 80840-2315, and any offers who believe are capable received after this date and time will be considered late in accordance with 52.212-1(f) and will not be evaluated.
