- VA VISN 18 intends to negotiate a commercial (FAR Part 12) sole source contract with MAXCOM under the authority of FAR 6.302-1. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-19. Only one responsible source and no other supplies or services will satisfy agency requirements. A justification for other than full and open competition has been prepared in support of this acquisition. This procurement is for a hazardous chemical and materials program (HazCom) that, in its entirety, fulfills the compliance requirements in 29 CFR 1910.1200 and categorizes workplace chemicals into 36 categories and three hazard levels in accordance with appendix "E" of cited reference. Information will be provided back to the VA, for training, labeling and chemical hazard identification by categories and hazard levels. This HazCom program (MAXCOM developed system or equivalent) will be web based and include printed format information with CD-Rom back up which shall be tailored to Veterans Integrated Service Network 18. It will provide written plans, barrier free access to MSDS and other information, material inventory, container labels, employee training, and procedures to keep system up to date. Interested persons may identify their interest and capability to respond to the requirement or submit a proposal. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. All proposals received by 3 P.M. Arizona Mountain Standard Time, September 19, 2007, will be considered by the Government. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
