Federal Maritime Commission Performance Work Statement Document scanning/indexing 1.Background The Federal Maritime Commission (FMC) is an independent regulatory agency responsible for the regulation of ocean borne transportation in the foreign commerce of the United States. The FMC administers the Shipping Act of 1984, as amended by Public Law 105-258 (The Ocean Shipping Reform Act of 1998), Section 19 of the Merchant Marine Act of 1920, the Foreign Shipping Practices Act of 1988 and Public Law No. 89-777. All of these statues were amended and modified by the Ocean Shipping Reform Act, which took effect on May 1, 1999. To achieve its statutory mandates, the FMC relies on technology to support its mission. The Office of the Secretary (OS) is the public's main contact point with the FMC. The OS receives and processes a variety of documents filed by the public, including: complaints initiating adjudicatory proceedings for alleged violations of the shipping statutes and other applicable laws; special docket applications and applications to correct clerical or administrative errors in service contracts; all communications, petitions, notices, pleadings, briefs, or other legal instruments in administrative proceedings; subpoenas served on the FMC or members and employees thereof; and Freedom of Information Act requests and other information requests. In addition, the OS maintains a Public Reference/Docket Library and provides for the issuance of publications and the authentication of instruments and documents of the FMC. The documents in the scanning and indexing system are stored electronically on large volume storage devices. The Commission's OS also coordinates the provision of scanning, indexing, and retrieval support for other Commission offices including the Office of General Counsel and various operating bureaus. 2.Objective/Scope The primary objective is to employ the services of a contractor to perform on-site scanning and indexing services for the FMC using the FMC's scanning equipment located in the OS. In addition, the contractor will assist with verifying files and documents maintained in the scanning system against existing logs. This would require, for example, comparison of documents listed in logs against electronic documents to verify that documents have been digitized and stored in our system prior to sending paper files to long-term storage. The contractor will also be required to assist with verifying that files from the old scanning system have been correctly transferred and organized into the new scanning system based on their ability to apply subject matter knowledge. The contractor is expected to offer suggestions to improve functionality and processes involved with the scanning program. Within broad parameters outlined by OS staff, the scanning contractor will be required to research and compile information necessary to accurately index and organize electronically converted files. Working independently, the scanning contractor will be required to prioritize assignments within the parameters established by the OS staff to meet weekly or project deadlines. Should any work be scheduled for performance at the contractor's facilities, the scanned and indexed files must conform to the FMC's formatting requirements and must be retrievable through the FMC's existing hardware and software technologies. Currently the FMC uses Laserfiche 7.2 as its document scanning software/system. Should the need arise, additional contract labor resources may be required, and will be negotiated pursuant to the PWS and contractor's labor category schedule. 3.Deliverables The contractor shall be responsible for providing 40 hours of on-site labor in accordance with this PWS 52 weeks per year, excluding the following federal holidays. Individuals assigned to this task shall be required to sign a FMC non-disclosure statement. 7.Government Furnished Resources The FMC will provide access to its building and offices, the required network access, and any available technical documentation regarding the existing scanning system and process. Training on FMC procedures and scanning equipment/software will be provided by designated FMC staff or FMC-approved vendors. 8.Personnel Security Requirements The contractor shall immediately notify the COTR of any changes in personnel assigned to this award. Any new personnel will be required to sign a non-disclosure statement before they can begin work. 9.Quality Assurance Surveillance Plan (QASP) The Government will periodically evaluate the Contractor's performance in accordance with the QASP. The purpose of the QASP is to ensure reliable, uninterrupted services are provided in accordance with the PWS. The plan will also ensure unnecessary complaints and acceptable performance. The Government's QASP includes the following elements: Periodic inspection of the Contractor's work Communicating customer complaints Progress meetings with the Contractor Method of Surveillance: Random Evaluation: This method employs a "spot check" style of evaluation and may be adjusted, based on quality trends. The Government retains the right to inspect all requirements of the contract. Unacceptable performance will be recorded and the Contractor shall be required to correct the unacceptable condition within a 24-hour time period. If the Contractor does not correct the unacceptable condition within 24-hours, the COTR will notify the Contracting Officer who will take appropriate administrative action for unacceptable performance.
