- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is restricted to Defense Technology Corporation of America, 1855 South Loop Avenue, Casper Wyoming 82601-9227, offers from concerns other than the above are not solicite d. This solicitation will be issued through FedBizOps as will any amendments thereto. This solicitation is issued as a Reques t for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2008-19, effective 17 September 2007. This requirement is for an indefinite delivery indefinite quantity cont ract for the M37 Mid-Sized Riot Control Disperser, NSN: 1040-01-463-0157, quantity minimum 20, total maximum quantity 1000, FOB Destination with shipments to Blue Grass Army Depot Central Receiving 2091 Kingston Highway, Bldg. 220 Richmond, Kentucky 404075 -5011. The contractor must provide a certificate of conformance (CoC) to verify the item being produced is in conformance with Purchase Description EA-PRF-2124 dated 17 August 1999 prior to acceptance. The following provisions apply to this acquisition: 52.212-1, Instruction to OfferorsCommercial;52.212-2, Evaluation-Commercial Items, paragraph (b); 52.212-3, Alternate I and III (a copy of this provision shall be completed and submitted with the offer; 52.212-4, Contract Terms and ConditionsCommercial I tem; and 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive OrdersCommercial Items along with the additional FAR clauses cited under paragraph (b) 1,5,7,11,12,13,14,14,16,18,24,28. This solicitation and synopsis is publish ed for subcontracting purposes only. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest an d capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within seven (7) days after date of publication of this synopsis will be considered by the Gov ernment. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determin ing whether to conduct a competitive procurement. Response is due by 09 November 2007, at 0900 am central daylight time.
