Description
This is a Notice of Contract Action (NOCA) for the award of a sole source contract to the OPNET Technologies, Inc Corporation. The Electronic Systems Center of the Air Force Material Command (AFMC) intends to contract for the annual maintenance, software upgrades and technical support, orginally awarded in Contract # 8726-06-C-0022, under the authority of FAR 6.302-1(a)(2)(ii)," Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". In this case, the USAF may deem products and/or services to be available only from the original sources in the case of follow-on contracts for the continued provision of highly specialized products or services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements (see 10 U.S.C. 2304 (d)(1)(B)). The contractor's competitive selection for original software procurement necessitates continuity with said licenses. Knowledge must also include the software upgrades required, provide technical support to the OPNET product and how the users intend to operate the software within the AMF JTRS program. This notice does not constitute a Request for Proposal nor does it restrict the Government as to the ultimate acquisition approach, nor should this notice be construed as a commitment. Any US commercial company who firmly believes that they are capable of meeting the above stated Government objectives and timeframes within this NOCA may identify their interest to the Government. Interested firms are requested to submit a statement of qualifications, along with supporting documentation to: 653 ELSG/KCK, Attn: Ms Allorria Harris, Contracting Officer in writing or by electronic transmission to: allorria.harris@hanscom.af.mil, or Capt Elizabeth Waggoner, Contract Specialist, elizabeth.waggoner@hanscom.af.mil. Responses must be received no later than 10 days after the date of this publication and should not exceed ten (10) pages on 8? x 11 inch paper with type no smaller than 10 pitch. An Ombudsman, Col Russell Blaine, Director, Commander's Staff, (781) 377-5106, has been appointed to hear concerns from offerors or potential offerors during the proposal and proposal development phases of this acquisition. The purpose of the Ombudsman is not to diminish the authority of the program director or the Contracting Officer, but to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. The Ombudsman should be contacted only with issues or problems that have previously been brought to the attention of the program manager and/or Contractor Officer and could not be satisfactorily resolved at that level. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
