- NAICS Code: 334516 NAICS Code: 334516 - The U.S. Environmental Protection Agency (EPA) National Enforcement Investigations Center (NEIC) intends to award a sole source fixed-price purchase order under the authority of Federal Acquisition Regulation (FAR) part 13, Simplified Acquisition Procedures to Thermo Electron North America, LLC. for maintenance services for the Noran System Six-300 Energy Dispersive X-ray Spectrometer (EDS), MAXray Wave Dispersive Spectrometer (WDS), and HKL Nordlys II Electron Backscatter Detector (EBSD). This equipment supports the Homeland Security Program and the Civil and Criminal Enforcement Programs at NEIC. This equipment is used in source receptor studies, Superfund projects, criminal projects and in other projects. The period of performance for this procurement will be from February 17, 2008 through February, 2009. NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE FOR THIS PROCUREMENT. It has been determined that Thermo Electron North America, Inc. is uniquely qualified to satisfy the Government's requirements, as they are the sole manufacturer of this highly specialized equipment. Thermo Electron is the only organization with the combination of hardware, software knowledge and available spare parts that is capable of properly servicing the EDS, WDS and EBSD analytical attachments. Additionally, the EDS, WDS and EBSD are highly specialized and require specially trained people to provide service and maintenance. This is necessary to ensure that all working parts are operating at optimum performance levels, and to ensure that they are maintained in a safe condition. No other organization offers a Standard Protection Plan for the NORAN System Six, MAXray, and Nordlys II detectors. The subsequent contract shall cover repairs, emergency on-site visits and preventative maintenance, which is required once each year. Replacement of defective parts as well as software updates will be included in the awarded contract. Notwithstanding, any firm that believes it is capable of meeting EPA's requirement as stated herein may submit a capability statement, which if received within fifteen (15) calendar days of the date of this announcement will be evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
