- Authority Cited: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). FAR 6.302-1 (a)(2)(iii) Only one responsible source and no other supplies or services will satisfy agency requirement. The Army Corp of Engineers Kansas City District intends to make a sole source award to a small business, Capital Sand Company, Inc, Jefferson City, Missouri 65110-4990 Description of Supplies/Services: The objective of this contract is to procure a highly specialized service for emergency dredging support from river mile 0 through 240. Background: The Corps of Engineers, Kansas City District is responsible for operation and maintenance of the authorized federal navigation channel on the Missouri River from Rulo, Nebraska to the mouth near St. Louis, Missouri. Th e channel is designed and constructed as a self scouring channel, however the upper Missouri Basin has experienced severe drought conditions over last seven years, requiring water conservation measures that limit main stem flows to those which support only minimum navigation service (reduced depth and width) for a shortened season. Proper functioning of the system (including scouring and prevention of shoaling) is flow dependent. Regular scheduled maintenance activities do not include dredging. Dredging is performed only as a last resort on an emergency basis when an actual shut down of the navigation channel has occurred or is eminent. Due to the economic impacts of a stoppage of river traffic it is essential that dredging activities commence within 72 ho urs of the stoppage in order to restore navigation. The navigation system is critical to the economy of the state of Missouri and also to the safety and environment. Each single barge (2 to 4 per typical tow) is equivalent to 58 large semi trucks on I-70 between St. Louis and Kansas City. This work requires highly specialized experience and equipment which is extremely difficult and costly to obtain in the commercial marketplace. Under this emergency dredging scope of work, the contractor must submit acceptable bonds, and begin work onsite within 72 hours of an issuance of a Notice to Proceed. The new contract will provide for a transition period of at least 30 days to allow seamless service in the event that different contractor wins the next, full an d open solicitation to follow. The Contracting Officer anticipates the award of a small business set-aside, Indefinite Delivery Indefinite Quantity (IDIQ) utilizing firm fixed price (FFP). Services for this award are applicable under NAICS code 237990 . The period of performance for this contract will be for six months with a three month option and the option to extend service clause. The value of this contract will not exceed $500,000.00; the guaranteed minimum will be $1,000.00. Respondents shall s ubmit information to the Contracting Officer on official company letterhead detailing clear and convincing evidence of their technical expertise and how an award to any other source would meet the highly unique and specialized requirements of the USACE-KC District emergency dredging mission. Submissions shall include affirmation of an active Central Contractor Registration (CCR), Data Universal Number System (DUNS) number or cage code and business size. The Contracting Officer will consider all corresponde nce received in response to this notice. Not withstanding the reference in numbered note 22, to a 45 day response. The intent is to issue a sole source solicitation within (7) seven days of the publication of this notice, unless a basis for competition ex ists. *Reference Numbered Note 22 Any responses to this notice shall be furnished electronically by 5:00 P.M.
