Description
The Office of Thrift Supervision (OTS), a bureau under the Department of Treasury, regulates and supervises the Thrift Industry nationwide. OTS hereby publishes this intent to negotiate and enter into a sole source purchase order with Professional Bank Services for two courses: ICES I and ICES II as follows: ICES I: The contractor shall design and teach for one week a beginning level course for the Office of Thrift Supervision (OTS) newly hired examiners. The course will focus primarily on statutes and regulations issued by the federal financial regulatory agencies, specializing on OTS requirements. Emphasis will be on BSA, fair lending and consumer compliance by the savings association industry. Examiners will learn the basic regulatory fundamentals required on an OTS compliance examination. The contractor is responsible for developing a 50 question, multiple choice test based on the four days of contactor instruction. The test will be administered by OTS on the fifth day. The following shall be included in the course: Modules discussing the OTS, Federal Reserve Board's and other regulations covering the purpose of the following: Truth-in-Lending Act; Bank Secrecy Act; Equal Credit Opportunity Act; Real Estate Settlement Procedures Act; HMDA; OTS Non-Discrimination Regulations; Fair Debt Collection Practices Act; Fair Housing Act; Homeowners Protection Act; and Flood Disaster Protection Act. Participants will learn how to: Determine a savings association's compliance with the statues and regulations; Analyze the savings association management's compliance responsibilities; Identify and evaluate the required disclosure forms; and Calculate the Annual Percentage Rate (APR) and escrow payments. ICES II: Design and teach a beginning to intermediate level course for the Office of Thrift Supervision (OTS) compliance examiners. The course will focus primarily on statutes and regulations issued by the federal financial regulatory agencies, specializing on OTS requirements. Emphasis will be on the Community Reinvestment Act small institution examination procedures, Privacy regulations, consumer deposit regulations and compliance by the savings association industry. Examiners will learn the basic regulatory fundamentals required on an OTS compliance examination. The contractor is responsible for developing a 50 question, multiple choice test based on the four days of contactor instruction. The test will be administered by OTS on the fifth day. The following shall be included in the course: Modules discussing the OTS, Federal Reserve Board's and other regulations covering the purpose of the following: Community Reinvestment Act; Expedited Funds Availability Act; Electronic Fund Transfer Act; Privacy Regulations; Right To Financial Privacy Act; Truth in Savings Act; Homeowners Protection Act; and Unfair and Deceptive Practices Act. Participants will learn how to: Determine a savings association?s compliance with the statues and regulations; Assess a savings association?s compliance with the Community Reinvestment Act; Analyze the savings association management?s compliance responsibilities; Identify and evaluate the required disclosure forms; and Calculate the Annual Percentage Yield (APY) rate. Each course will be held for 5 consecutive business days. The contractor is responsible for 4 days. The Contractor shall perform the following tasks: Design an ICES I and ICES II for OTS compliance examiners, per the specifications outlined in the ?Course Objectives? section; Develop the course materials that will be distributed during the class and used as reference materials by OTS examiners. Course materials shall include an agenda, lecture notes, case studies and reference materials; and Instruct the course. The course will be critiqued by the examiners and various OTS staff. A segment at the end of each course will be devoted to soliciting feedback from participants. Verbal and written comments will be accepted and provided to the contractor. The contractor shall consult with the OTS about each course and training material modifications, and will make appropriate modifications within a ?to be determined period of time?. The teaching method shall combine lecture, case studies, group discussion and visual aides. The contractor shall emphasize class participation. Contractor/Instructors Qualifications consisting of: Contractor will have knowledge and experience of the financial regulatory industry relative to banks, thrifts or similar financial institutions; Contractor?s instructors shall have extensive hands-on experience with the federal regulatory examination process; Resumes for each instructor shall be provided with your quote; Contractor?s instructors shall have extensive teaching and training experience in compliance statues and regulations; Contractor shall have the support capability to develop training materials, write course materials, develop the test and meet deadlines and make course revisions; Training and written course materials shall be delivered to the OTS site in advance of each class. OTS anticipates about 15 - 20 participants for the course; and OTS will own the materials. Delivery Requirements are as follows: Course outline and objectives - 3 months before offering; Draft of participant/instructor manuals/test - 2 months before offering; and Final copy of manuals, and related A/V and instructional materials ? 1 month before course offering. The OTS intends to solicit and negotiate with only one source under the authority of FAR 6.302. A purchase order will only be awarded after determining that it is the most advantageous means of satisfying OTS? needs. Interested persons may identify their interest and capability to respond to the requirement or submit quotes. This notice of intent is not a request for competitive quotes. However, all quotes received with pricing and sufficient technical documentation to establish a bonafide capacity to meet the requirement received by 2:00PM EST, 2/20/08 will be considered by the Government. Any response to this notice shall show clear, compelling, and convincing evidence that competition will be advantageous to the government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice of intent is not a request for competitive quotes and no solicitation document is available. Such information, if submitted, should be emailed Isabel.romancogswell@ots.treas.gov. QUESTIONS SHALL ALSO BE SUBMITTED VIA EMAIL BY 2:00 P.M. EST, 2/14/08. TELEPHONIC QUESTIONS WILL NOT BE ACCEPTED. If this procurement is competed, no additional synopsis will be published and a request for quote will only be forwarded to the intended vendor and firms that respond to this synopsis of intent.
