Description
The United States Department of Energy (DOE), Environmental Management Consolidated Business Center, is pursing a sole source contract with LMK Engineers, LLC (LMK), 72 Robinson St, Pottstown, PA pursuant to the Federal Acquisition Regulation (FAR) Subpart 6.302-5(b)(5), Authorized by the HUBZone Act of 1997, 15 U.S.C. ?? 657a. LMK is a HUBZone Small Business Concern. The proposed contract will be for an eighteen (18) month period of performance beginning on or about March 19, 2008. DOE intends to solicit and negotiate with only one source and no other sources will be considered. This notice satisfies the requirements of FAR Part 5. The contract is for specialized technical services necessary to support acquisition of the follow-on Depleted Uranium Hexafluoride (DUF6) Operations contract. Tasks will consist of research, review and writing of specifications; defining technical requirements in development of statement of work; proposal evaluation services; assistance in the construction of government cost models for various activities; as well as other performance requirements. Primarily, the contractor will assist federal staff in identifying and defining the technical requirements needed to construct an adequate Statement of Work (SOW) and to evaluate proposals for the follow-on acquisition to obtain a contractor to operate the DUF6 facilities to convert the DOE inventory of DUF6 to a stable chemical form acceptable for transportation, beneficial use/reuse, and/or disposal. Substantial knowledge of DUF6 conversion facilities and processes will be essential to performing these tasks; LMK obtained this expertise while providing DOE oversight services for the DUF6 project and is the only known organization, other than the conversion contractor, to have sufficient expertise. The DUF6 conversion facilities employ a new and unique design with one of the key processing steps utilizing proprietary technology. Moreover, the contractor involved in providing these services would be precluded from competing under the SOW to be the DOE DUF6 conversion contractor. Because of the unique nature of the process and its design operating parameters, it is not reasonable for DOE to expect any other contractor, to have the substantial requisite expertise to advise DOE on this process. Time is of the essence in obtaining a follow-on DUF6 operations contractor so DOE cannot delay this contract while other concerns obtain this expertise. The value of this effort is estimated to be under $550,000. Therefore, it is deemed appropriate to award a sole source contract under a HUBZone Small Business Concern set-aside, as authorized by 15 U.S.C. ?? 657a (b)(2); FAR 6.302-5(b)(5) and 19.1306, because only one responsible source is available that can satisfy the needs of the Department. The North American Industry Classification System (NAIC) Code for this requirement is 541611. HUBZone small businesses that believe they have a superior solution to DOE???s proposed award to LMK must respond in writing to the Contracting Officer. The written response must include a general technical proposal for performing the services mentioned in this announcement, past performance client information for similar work, resumes of individuals who would be potentially assigned to the work and a rational why the your firm???s solution would be in the Government??? s best interest. *** See note 27.
