- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13 and FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Bureau of Indian Affairs (BIA), Rocky Mountain Region (RMR) intends to award an Indefinite-Delivery / Indefinite-Quantity, commercial item contract for a base and four (4) option years in response to Request for Quotation (RFQ) RMC00080015 to acquire 1) evaluations and documentation services under the National Register of Historic Places Act and 2) Historic American Building Survey (HABS) / Historic American Engineering Record (HAER) surveys of historic architectural sites, structures and significant engineering / industrial sites on the Blackfeet, Crow, Fort Belknap, Fort Peck, Rocky Boy?s, Northern Cheyenne and Wind River Indian Reservations in Montana and Wyoming. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2006-05. The associated North American Industry Classification System code is 712120 and the small business size standard is $6.5 million. PRICE SCHEDULE: Offers should be submitted for ITEM 001: Resumes of key personnel that demonstrate they meet the Secretary of Interior?s Professional Qualification Standards in history, architectural history or historical architecture; ITEM 002: A list of completed projects that demonstrate an experience in working with Native American Tribes; ITEM 003: Demonstrated expertise and experience in conducting National Register of Historic Places evaluations and HABS / HAER documentation; ITEM 004: Reference list of at least three (3) previous employers the contractor has performed work for; ITEM 005: Provide a cost per hour for each staff person involved with completion of the requirement. Minimum Order: 8 Hours; Maximum Order: 2,032 Hours. ITEM 006: All Per Diem and Mileage Rates that will utilized by the contractor. The quotation must be inclusive of transportation, food, lodging and related costs associated with fulfilling the requirement. All work completed under the resultant contract shall conform the requirements of the Statement of Work. STATEMENT OF WORK/MAJOR DUTIES: Contractor to provide all equipment, materials, supplies and personnel for any work conducted for National Register evaluations will meet the Secretary of Interior?s Standards and Guidelines for Archaeology and Historic Preservation. Documentation will meet the Documentation Standards defined in Federal Regulations 36CFR800.11. Written reports will include: a description of the undertaking and its potential effects; a discussion of the historic context; a thorough description of the setting and condition of the site, building or structure, along with photographs, maps and drawings, as appropriate; a discussion of its National Register eligibility; and completed BIA site forms, as well as National Register Nomination Forms, when required. Evaluations of National Register eligibility will be based on the criteria as defined in Federal Regulations 36 CFR 60.4 CHANGES. HABS/HAER documentation will meet one of the four documentation standards defined in the Secretary of Interior?s Standards and Guidelines for Architectural and Engineering Documentation: HABS/HAER Standards. The level of documentation will depend on the nature of the site, building or structure, and the type of undertaking. It will include a written history and description, and may include large format photographs and drawings. Contractors will be expected to compile the necessary documentation packages and should have access to individuals and/or equipment to provide the photographs and/or drawings, when required. SUPERVISION: Works under the supervision of the BIA, Branch of Environmental, Cultural Resources and Safety (BECRS). Work is planned and conducted according to need under the guidance of the BECRS Office and is reviewed periodically for effectiveness and contribution to goals of the program. REPORTING REQUIREMENTS: The Privacy Act of 1974 mandates Contractors maintain complete confidentiality of all records and pertinent information that may come to their attention while providing services under the contract.. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. All regulations and policies applicable to these Acts shall be enforced. PERIOD OF PERFORMANCE: The contract shall be in effect from the time of award and shall be in effect for one (1) base year award with options to renew for four (4) additional years. GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, SUPPLIES AND SERVICES: The Contractor will be authorized to use all areas of the facilities made available to them. The Contractor must request clearance in order to access restricted areas of the facilities; authorization must be granted and is to be used only for official business activities relating to job performance. The BECRS will orientate the Contractor as to their specific duties and responsibilities. The BECRS is responsible for getting the Contractor access and clearances to all pertinent areas, necessary to carry out performance duties. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. CONTRACTING OFFICER?S TECHNICAL REPRESENTATIVE (COTR): The COTR shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the BECRS Office, James Battin Federal Building in Billings, Montana for acceptance and receiving. The Contractor agrees to include the following information on each invoice: (1) Contractors name, address; (2) Contract Number; (3) Invoice number and date; (4) Cost or price; (5) Dates of Service including the number of hours worked; and (6) Remit to address. Payment shall be made via ACH-Direct Deposit by the BIA-RMR Accounting Branch, 316 North 26th Street, Billings, Montana 59101-1397. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where Federally funded services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI): A CNACI must be completed for all contractor personnel providing services within the Rocky Mountain Region. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, requires the BIA to conduct a character and criminal history background investigation on all contractors performing services in Government facilities. The character and background investigations will be conducted by the BIA. SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the BIA customers receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. Task orders issued under this contract will specify the exact nature of the work to be conducted, and level of documentation that may be required. Deliverables will include written reports that meet the documentation standards described above. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items; 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference; 52.216-27 Single or Multiple Awards. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (JAN 2004): (a) The Government may award a single or multiple contracts resulting from this solicitation to the responsible offeror?s whose quotation conforms to the solicitation and is most advantageous to the Government, price and other factors considered. Award will be made on the basis of price and other factors representing the best value to the government. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. The following FAR clauses are applicable: 52.204-4, 52.204-7, 52.204-8, 52.212-4, 52.212-5, 52.215-5, 52.216-27, 52.217-8, 52.217-9, 52.219-6, 52.223-5, 52.223-6, 52.224-1, 52.224-2, 52.229-3, 52.232-18, 52.237-2, 52.237-3, 52.242-15, 52.242-17, 52.245-1 and 52.245-2. The following FAR clauses cited in 52.212-5 are applicable to the acquisition: 52.203-6 with Alternate I, 52.219-8, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13 and 52.232-33. National Historic Preservation Act of 1966 as Amended (16 USC 470) and its Implementing Regulations (36 CFR 800). PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the BIA Rocky Mountain Region, Acquisition Management, 316 North 26th Street, Billings, Montana 59101, no later than the close-of-business on March 25, 2008. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your company?s name and address.
