- NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT: Under the authority of FAR 6.302-1, it is the Government's intent to award a sole source service contract to the PUEBLO OF SANTA ANA, Sandoval County, New Mexico for Jemez Canyon Reservoir Sediment C haracterization. THIS IS NOT A FORMAL SOLICITATION. This synopsis is not considered a Request for Quotation or Proposal. No solicitation document is available, and telephone requests for a copy of the solicitation will not be honored. Any response to t his notice must show clear and convincing evidence that competition would be advantageous to the Government. All responses received within 15 days will be considered. If no affirmative written response is received, the service contract will be awarded wi thout further notice. A determination by the Government not to compete this proposed service contract is based on the Tribal Sovereignty of the Pueblo of Santa Ana; the Pueblo of Santa Ana has planned to perform the required service themselves, due to the confidential nature of the results of the service. Based on the U.S. Fish and Wildlife Services 2003 Biological Opinion regarding the Rio Grande Silvery Minnow and the Southwestern Willow Flycatcher, the U.S. Army Corps of Engineers (COE) is required to test presumed habitats of the Silvery Minnow and Southwestern Willow Flycatcher, this includes the Jemez Canyon Reservoir, located on Pueblo of Santa Ana tribal land. The Pueblo of Santa Ana is willing to grant the COE access, if the Pueblo of Santa Ana performs the service themselves. Award of this service contract will be based upon the Tribal Sovereignty of the Pueblo of Santa Ana, the possible responses to this notice, and is solely within the discretion of the Government.
