Description
The Government intends to solicit and negotiate with only one source, Motorola, 7031 Columbia Gateway Drive, Columbia, MD 21046. The procurement will be conducted on a sole source basis in accordance with the statutory authority of 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition is for maintenance support for Motorola radios, ancillary equipment, and Trunked Radio subsystems not under warranty. Subsystems include components of the Early Warning System (EWS), Air Crash System and Water Lift system. This contract also provides system administration of the Trunked Radio version 7.1. Service includes an annual preventative maintenanceinspection, a two-hour response and a four-hour restoration time, and 24x7x365 technical support availability. The basis for restricting competition is because Motorola has proprietary rights to the equipment, boards, and software. The ancillary equipment within this requirement are sub-systems of the pre-existing Motorola trunked system, which is under warranty. The NAICS code for this procurement is 811213 and the small business size standard is $6.5 million. This sole source requirement will be procured under Other Than Full and Open Competition procedures and awarded on an unrestricted basis. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer not later than 18 April 2008. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Government will proceed with the sole source negotiation with Motorola. Award will be made in accordance with FAR Part 12, Acquisition of Commercial Items.
