Requisition Number: FDA1041798 The Food and Drug Administration (FDA) intends to award a purchase order on a non-competitive sole source basis to Biomerieux, Inc., 100 Rodolphe St., Durham, NC 27712-9402. FDA will purchase the following: 24 boxes of ICS Assay kits #30435 24 boxes of ICS Broth #42610 24 boxes of SLM #30702 29 boxes of API 20E Kit #20100 24 boxes of VP-1 and Vp-2 #70422 48 boxes of VIDAS Staph Enterotoxin SET2 #30705 The purpose of the various kits or reagents is to develop methods used for training and the detection of foodborne contaminates which maybe a result of acts of terrorism or natural occurring events that effect our nation’s food source. The knowledge and information obtained regarding this method for detecting foodborne disease and associated phenomena will enhance FDA’s ability to protect and enhance the safety of the food supply. Biomerieux Inc. is the sole manufacturer of the Vidas test kits and supplies and accessories. Center for Disease Control (CDC) has approved no other method for the detection program submitted by FDA under the select agent registered program and there are no potential substitutes. No other vendors that can provide the capability required for FDA’s research program. There are no approved substitutes and there are no similar instruments. In addition, the methods used in the detection program make reproducibility and ease of use the “gold standard”, and this can only be conducted using known and proven methods that have been approved by CDC for all labs in the USA to measure and detect microbial phenotypes. As the only known standard kits capable of providing the capability necessary, the Biomerieux test kit provides uniformity with the de facto international standard for research and rapid response. To select any other kits and reagents would place FDA research in this area out of step with the research community and would reduce both the capability and credibility of research in this critical scientific arena. THIS IS NOT A REQUEST FOR QUOTES. However, sources may submit descriptive literature, fully documenting their capabilities, which will be considered by the Agency. A determination to compete this procurement based on response(s) to this notice is solely within the discretion of the Government. All inquiries must be received by 10:00 AM (1000) EST on 23 April 2008 to the attention of David Kordel, david.kordel@fda.hhs.gov. The FDA intends to make an award immediately after the response date of this notice. The award will be made in accordance with FAR Part 13, Simplified Acquisition Procedures.
