- REGULATED MEDICAL WASTE/SHARPS RECYCLING SERVICES VA-251-08-RP-0144: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-24. The North American Industry Classification System Code is 562112, Hazardous Waste Collection. The small business size standard is $11.5 million average annual receipts for the past three years. This procurement is a total set-aside for small service-disabled veteran-owned business concerns in accordance with IL-07-08.1 VA Notice of Total Veteran-Owned Small Business Set-Aside. Offerors are encouraged to submit quotes based on the work requirements specified herein for a base period from date of award (approximately June 1, 2008) through September 30, 2008, with four pre-priced option years from October 1, 2008 through Sept 30, 2012. Proposed rates should include all costs associated with Request For Proposal VA-251-08-RP-0144 as follows: WORK STATEMENT REGULATED MEDICAL DISPOSALC.0 General: The contractor shall provide all necessary supervision, processing, equipment, supplies, packaging, labor/personnel, manifests, reports, and transportation services for the disposal of regulated medical waste in accordance with all local, state, and federal regulations. Services are required at the Medical Center in Saginaw, Michigan and at the three (3) Community Based Outpatient Clinics (CBOCs) located in Traverse City, Oscoda, and Gaylord, Michigan. Regulated Waste Pick-ups shall be made weekly at the Saginaw facility and two (2) times per month at the CBOCs between the hours of 8:00 am and 2:00 pm. Regulated Medical Waste shall be picked up a minimum of one (1) time per calendar week at Saginaw and two (2) times per month at the CBOCs. Vendor shall provide plastic, sealable, stackable tubs to store regulated medical waste. Tubs must clearly be marked as regulated medical waste. C.1 Materials provided by the contractor shall include, but not be limited to the following: Plastic, sealable and stackable containers for collection and removal of regulated medical waste. Volume shall be approximately 28 gallons. Unassembled cardboard boxes with tape for sealing for disposal of cytotoxic waste. Boxes shall be approximately 18"L x 18"W x 24"H, or equivalent. C.2 Permits, licenses, approvals, and insurance: The contractor shall also comply with state and local requirements, including obtaining all necessary permits, licenses, and approvals. All Department of Transportation and Michigan Department of Transportation rules and regulations must be strictly complied with. Contractor shall ensure that the handling and final disposal of regulated medical and sharps waste is in compliance with the Department of Transportation (DOT), Environmental Protection Agency (EPA), Department of Health (DOH), Department of Environmental Conservation (DEC), Food and Drug Administration (FDA), and applicable Federal, State and Municipal governmental regulations and codes. This shall include transport vehicles, marking requirements for containers, and manifest requirements. Contractor shall provide proof of a State of Michigan EPA processing permits, transportation licenses, all City Permits, and proof of a permit annually thereafter. Contractor shall provide proof of a minimum of $1,000,000 Environmental Restoration Insurance and provide proof annually thereafter. C.3 Spill Reporting Requirements: The contractor is responsible for reporting to the COTR all spills, regardless of quantity, and all personnel exposures. Such reports shall first be reported by telephone immediately following the incident and shall be followed up in writing no later than seven (7) days after the initial report. When reporting a spill, the following information shall be furnished: (1) Quantity spilled; (2) Exact location of spill; (3) Containment procedures initiated; (4) Clean-up and disposal procedures. If any spills occurred during contract performance these should be briefly summarized. Include: quantity spilled, personal injury involved, assistance required, and a narrative summarizing all on-scene visits made by local, state or federal officials. The Contractor is solely responsible for any and all spills or leaks during the performance of the contract. The contractor agrees to clean up such spills or leaks to the satisfaction of the Government in a manner which satisfies the applicable state, federal and local laws and regulations, at no cost to the Government. C.4 Manifesting: A waste manifest is required for the removal from the Government premises of all waste in this contract. The contractor shall obtain and prepare all manifests and furnished to the COTR. All waste picked up shall be listed. The pick-up manifests will be reviewed and signed by the appropriate VA Government official (COTR or his/her designee). Manifests shall be submitted in such a manner as to comply with the timeliness prescribed by state regulations, and in any case, prior to, or in conjunction with invoicing. C.5 Incineration: The Contractor shall prepare a Certificate of Incineration. This certificate is to be submitted with, or prior to, the invoices. Any differences between the manifest and what was incinerated must be thoroughly described and documented. Attachments to the Certificate of Incineration can be used, if necessary. Documentation must be provided to prove that the disposal of all regulated medical waste has been accomplished. A Certificate of proper disposal shall be attached to the manifest and submitted with, or prior to, the submittal of invoices. C.6. Safety Requirements: Contractor personnel and equipment shall comply with all applicable state, federal and local regulations. The contractor agrees that his personnel and equipment are subject to safety inspections by Government personnel while on Federal property. The Contractor shall ensure that all personnel involved in the handling, repackaging, and transportation of the items listed herein shall be trained in the areas of spills, and general first aid procedures. C.7 Confidentiality: Contractor is required to maintain one hundred percent confidentiality of all waste, regardless of origin. Contractor will secure waste properly and protect sensitive information from third party sources. A Business Associate Agreement is required between the VA and the successful offeror. C.8 Sharps containers and exchange services Contractor shall provide all sharps containers, hardware and labor for installation of brackets and exchange services at a frequency to be agreed upon by the COTR or as needed, regular collection and disposal of sharps waste from the premises as part of a "dock to dock" sharps management/collection program. The contractor's reusable container sizes must be able to match up with the disposable containers currently being utilized. "Sharp Waste" shall include hypodermic needles, syringes and scalpel blades, excluding any hazardous waste, radioactive waste, and pharmaceuticals. The Medical Center will be responsible for the segregating of all waste in accordance with Federal, State and Local requirements. C.8.1 Sharps Containers: Contractor shall supply reusable sharps containers which are rigid, heavy duty, puncture resistant, leak proof on sides and bottom, with a "sloped shoulder" designed to prevent needles or other objects from being left on top of the container. Sharp containers shall be secure to tops or sides of wheeled medication carts. Contractor shall provide containers that comply with the Federal, State and Local regulations regarding labeling. All containers shall be clearly labeled with the Biohazard symbol and the word "BIOHAZARD" displayed on them. Contractor shall notify the COTR of any problems or delays with supplying sharp containers. C.8.2 Estimated Quantities: Contractor shall provide the following estimated number reusable sharps containers: 2 gallon (191), 12 gallon (11), chemo (4), table top (6), and med cart (10). (NOTE: The Medical Center can request up to fifty additional containers at no additional cost upon completion of the six-week stabilization period) C.8.3 Collection, Reprocessing and Disposal of Contents: Contractor shall collect, reprocess containers and dispose of waste in compliance of all applicable Federal, State and Local regulations including but limited to the following standards: (1) Occupational Safety and Health Administration (OSHA), including but limited to Blood Borne pathogens Standard 29 CFR 1910 and 1030 and the Needle Stick Safety and Prevention Act HR 5178 as it specifically relates to reusable containers, (2) the Michigan Environmental Protection Agency (EPA), (3) Food and Drug Administration (FDA) including but not limited to Title 21 of the Code of Federal Regulations (CFR) and Quality Systems Regulation (QSR) with regards to reprocessing, validation, reporting and annual registering for all equipment used to release medical equipment into commerce. The VA reserves the right to thoroughly inspect the Contractor's facility and treatment plant to assure acceptable standard of performance. C.8.4 Log of Sharp Waste shipment. Contractor shall maintain a log of regulated "Sharp Waste" shipments which include quantity of waste shipped, sources and delivery points. (Note: This requirement shall not be confused with manifest requirement mentioned and referred to elsewhere). Records shall be kept on file for three years. C.8.5 Contingency plan: Contractor shall have in place and maintain a valid to meet the requirements of the contract. Contractor shall incur all cost associated with fulfilling this contingency plan at no additional expense to the Government. Contractor shall be liable for all expenses incurred by the Government due to the contractor's inability to perform in accordance with these requirements. C.8.6 Contractor's Employees: Contractor shall provide their employees with appropriate protective clothing, equipment and apparel as prescribed by the Occupational Safety & Health Administration (OSHA) and the Department of Labor (DOL). Technician shall be dressed neatly in appropriate uniform, free from visible soil or excessive wrinkling, and wear the VA's identification badge at all times when servicing at the VA facility. The provision at 52.212-1, Instructions to Offerors - Commercial (NOV 2007), applies to this acquisition. The provision at 52.212-2, Evaluation - Commercial Items (JAN 1999), applies to this procurement. Offerors are required to provide all requested documentation with proposals. The following evaluation factors are listed in descending order of importance. I. Minimum Requirements: Offers must submit, at a minimum, the following documentation, to include subcontractors. Failure to submit may result in elimination from consideration. ---Current License to handle regulated medical waste to include cytotoxic waste in the State of Michigan. ---Training certificate for contractor employees proposed to handle and transport regulated medical waste. ---Copies of all required Federal State and local environmental compliance permits ---Copy of Environmental Restoration Insurance Certificate ---Documentation of a minimum of two years experience in the regulated medical handling industry ---Documentation of a minimum of one year experience in reusable sharps container II. Technical Factors: a. Additional years of experience in the regulated medical handling industry. b. Additional years of experience in reusable sharps container industry c. Contingency Plan d. Sharps Containers - Offer shall provide documentation of the following to include a representative sample container and written specification on each container to be use in performance of the contract. i. Ability to provide container sizes as specified ii. Security of sample container iii. Meets puncture resistance test e. Quality Management Plan f. Records Management (Copies of manifest documents) III. Past Performance: Furnish a minimum of three (3) past performance references. References must include both prime and subcontractor references for work in the regulated medical waste and sharps recycling industries. Include point of contact for each reference, to include name, fax and telephone numbers, and email address of contact. IV. Price: Technical and Past performance, when combined, are greater than price. Offerors are required to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, (NOV 2007), with its offer.
