UNITED STATES OF AMERICA16C DATE SIGNED BY (Signature of person authorized to sign)(Signature of Contracting Officer) ATTACHMENT A 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (listed in order of importance) qualifications of officer, capability of offeror and price The following information is to be addressed separate from the cost proposal: 1. Technical Capability: Resource capacity of firm to provide required services and required equipment a.Professional and management capacity b.Knowledge of Federal, State and local laws and regulations governing the performance of the contract requirements. 2. Past Performance a.This factor will indicate successful performance and ability to fulfill the requirements of the solicitation. Offerors are required to furnish the following information: b.State the number of years that the offeror's firm has provided same or similar services as those required in solicitation c.Identify three (3) VA or other Federal, State or Local Government customers for whom the offeror has provided same or similar types of services described in this solicitation within the past three-(3) years. d.If three (3) or less have not been contracted, submit commercial customers within the past three (3) years, making a total of three (3) references. e.Briefly describe the services provided to the customer, service periods, approximate annual dollar value of the services provided, and information on problems encountered, if any, and the offeror's corrective actions. f.Indicate the name, voice and facsimile telephone numbers, and electronic mail address of at least one point of contact at each reference listed. This individual will be contacted to provide performance evaluations such as the compliance with schedules, training and skill levels of personnel accomplishing the work, responsiveness to customer requirements, effectiveness at identifying and correcting problems and overall satisfaction with service performance. g.In addition to references identified by the offeror, the Government may use other sources in evaluating the offeror's overall past performance record. 3. Offerors shall provide pricing as requested on Schedule of Supplies/Services a.Unit prices for the base year and each option year will be used to calculate the offeror's total price. The evaluation factors are arranged in descending order of relative importance. Award will be made on the basis of the combined ratings of the non-cost factors with the best-valued price of proposals meeting or exceeding the acceptability standards of non-cost factors, which will be most advantageous to the Government. Technical, and past performance, when combined, are more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
