- The Department of Education (ED) intends to issue a contract for research to provide information and criteria needed to select the most accurate data source identified in ESEA Title III legislation. The research findings will provide a basis for the allocation of Title III funds to the States on the more accurate of two allowable sources of data on the population of limited English proficient (LEP) students and immigrant children and youth. The two allowable sources identified in the Title III legislation are (1) estimates based on the U.S. Census Bureau's American Community Survey (ACS), and (2) counts provided by the States. A recent report by the GAO revealed significant differences in LEP estimates generated using these two data sources and recommended that the Department perform a study to establish the relative accuracy of the two data sources. The contractor shall implement the study, conducted by a panel of experts, to establish the relative accuracy of the two databases. ED intends to place a contract on a sole source basis to the National Academy of Sciences (NAS), pursuant to FAR 6.302-1, 41 U.S.C. 253(c ) (1), for a study conducted by a panel of experts, using appropriate methodologies, to examine the relative accuracy of State-collected data vs. U.S. Census Bureau data for determining the number of LEP students used in calculating NCLB Title III allocations to the States. NAS, which has significant knowledge, technical expertise, and many years of experience in scientific research, is uniquely qualified to conduct the needed research and is the only source that will satisfy ED's requirement. It is the only organization recognized in legislation as a source of expert advice to the Government, is unequalled in its authority to speak on scientific issues, and unequalled in its reputation for objectivity that transcends any appearance of political influence or advocacy.
