Description
This is a notice of intent by the Environmental Protection Agency, Region 2, to extend Contract No. 68-W-98-210 with CDM Federal Programs Corporation (CDM), and Contract 68-W-98-214 with Tetra Tech EC, Inc. (Tetra Tech), for up to six months. The extensions to these contracts are critical to ensure continuity of critical services for on-going existing projects. No new tasks will be issued under these contracts during this extension period. EPA is currently reviewing and plans to award new competitive contracts. CDM and Tetra Tech are the only sources to perform work on these twenty-seven (27) and thirteen (13) specific existing tasks, respectively, because of the highly specialized services that are performed under these contracts; their technical familiarity, detailed processing, and understanding of the current work plans; the need for the seasonal scheduling of the work; to meet oversight mandated consent decrees to avoid substantial damage in enforcement actions and litigation with potentially responsible parties; unavailable cross-over capacity from other existing contracts; and to avoid a substantial duplication of cost. This extension will ensure the specific projects are uninterrupted and can be completed on schedule to meet EPA’s commitments for site remediation. As many of the construction efforts are at critical stages and this is the best time of year for this work to be performed, it is in the best interest of the Government to extend the existing contracts pending award of the follow-on competitive contracts which are currently under evaluation. The proposed contract modifications will be issued under the authority of FAR 6.302-1 for other than full and open competition. The contracts with CDM and Tetra Tech are for continuation of existing engineering, technical and management services in support of Region 2’s remedial response and enforcement oversight at sites of release or threatened release of hazardous substances under the Comprehensive Environmental Response Compensation and Liability Act of 1980 (CERCLA) and the Superfund Amendments and Reauthorization Act of 1986 (SARA). These services cover sites in New York, New Jersey, Puerto Rico, and the U.S. Virgin Islands. The planned contract actions represent a “new work” extension of each contract for up to six months, effective July 6, 2008. These modifications are necessary in order to ensure continuity of critical services for ongoing existing projects under these contracts, pending the award of contracts resulting from Solicitations PR-HQ-07-10525 and PR-HQ-07-11352. Award of the contracts resulting from these solicitations has been delayed, which has necessitated that the above existing contracts be extended until these awards can be made, in order to provide for continuation of essential work on existing projects without interruption. Region 2’s requirements to be covered by these extensions include ongoing remedial investigations and feasibility studies, remedial designs, implementation of remedial actions, and oversight of responsible party and potentially responsible party remediation projects to address and mitigate threats to human health and the environment caused by hazardous substance contamination in the Region 2 area. No new tasks will be issued under these contracts during this extension period. The work to be extended represents twenty-seven (27) existing projects under Contract 68-W-98-210 and thirteen (13) existing projects under Contract 68-W-98-214. This notice is not a request for offers. A determination not to compete these proposed procurements based on response to this notice is solely within the discretion of the Government.
