Description
Notice of Intent Sole Source Award to CCH, Incorporated The Contracting Center of Excellence (CCE) on behalf of the Office of the Armed Services Board of Contract Appeals (ASBCA), and in accordance with FAR 6.302-1, intends to negotiate a sole source award with CCH, Incorporated, Wolters Kluwer Law and Business, 4025 W. Peterson Ave, Chicago, IL 60646-6085. This requirement is for a 12-month subscription to provide the Board of Contract Appeals Decision Reporter. Interested persons may identify their interest and capability by responding to this requirement by 9 June 2008 at 10:00 am (EST). Capabilities statements are limited to 10 pages. This notice of intent is not a request for competitive proposals. However, all capabilities statements received within the time period specified will be considered by the government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose determining whether to conduct a competitive procurement. Statement of Work For Board of Contract Appeals Decisions Reporter for the Armed Services Board of Contract Appeals. 1.0 Background. The Armed Services Board of Contract Appeals (ASBCA) is an independent Department of Defense (DoD) agency that adjudicates contract disputes for the military departments and others. The mission of the ASBCA is to provide, to the fullest extent practicable, impartial, informal, expeditious, and inexpensive resolution, under the Contract Disputes Act of 1978, 41 U.S.C. 601-613, or the ASBCAs Charter, of disputes arising out of or related to contracts entered by the Department of Defense (including the Departments of the Army, Navy, and Air Force), the National Aeronautics and Space Administration, and any other department or agency, as permitted by law. 2.0 Scope. To facilitate issuing decisions, the ASBCAs Judges and legal staff require printed case Reporters that include the published decisions of all of the Boards of Contract Appeals. This Reporter must be a recognized, official Reporter that is used in case citations by all of the Boards of Contract Appeals, the United States Court of Appeals for the Federal Circuit, and the other federal courts. 3.0 Period of Performance. The period of performance shall be from 1 July 2008 through 30 June 2008. 4.0 Requirements. Each Reporter loose-leaf supplement or hardbound volume shall include the following: a. Complete and accurate copies of the full texts of decisions rendered by the Boards of Contract Appeals published since the printing of the last Reporter volume. Each decision report shall also include the name of the case, the docket number, the contract number, the date of the decision, a headnote or headnotes, and the names of the attorneys representing the government and the contractor or subcontractor litigants if available. b. A topical index listing common contract disputes terms, along with references to where in the volume those terms can be found. c. A case table that alphabetically lists the decisions reported, along with their location in that volume. d. A docket number finding list that lists the decisions reported by docket number, along with their location in that volume. The docket numbers for the decisions of each Board of Contract Appeals shall be numerically listed in ascending order under the abbreviated name of that Board. 5.0 Deliverables. On a weekly basis, the contractor shall provide 18 sets of loose-leaf Reporter supplemental pages that include all of the published decisions issued by the Boards of Contract Appeals since publication of the last loose-leaf supplemental sets. On a semi-annual basis, the contractor shall provide 18 sets of a hardbound Reporter volume that includes all of the published Boards of Contract Appeals decisions that were previously reported in the loose-leaf supplements since the publication of the last hardbound volume. 6.0 Government-Furnished Equipment or Supplies. No government-furnished equipment will be provided under this contract. On a weekly basis, the ASBCA will provide the contractor with paper copies of its published decisions. The contractor is responsible for timely obtaining copies of published decisions from the other Boards of Contract Appeals. 7.0 Performance Management. All products and services will be managed by the contractor. ASBCA personnel will inform the Contracting Officers Representative if any of the products are not furnished as stipulated in the contract.
