- This purpose of this notice is to provide the Contracting Community with knowledge of the Government's intent to sole source the procurement described herein in accordance with the statutory authority desrcibed herein. The Contracting Officer for this procurement is Ms. Michelle Donnelly of the General Services Administration - Region 3 in Philadelphia, PA. Ms. Donnelly may be reached at (215) 446-4498 and all inquiries regarding the information contained herein shall be directed to the Contracting Officer. This procurement is for chilled water utility service to be provided for five (5) Federal Buildings in Baltimore, Maryland to include; Edward A. Garmatz U.S. Federal Courthouse, George H. Fallon Federal Office Building, U.S. Customs House, U.S. Appraisers Store and SSA Metro West Federal Office Building. Chilled water service is necessary to provide cooling for said buildings’ HVAC systems which are essential in keeping these facilities open, functioning and suitable for tenancy. Per 41 U.S.C 501 (b) (1) (B), The General Services Administration intends to procure said services for the maximum allowable period of ten (10) years. Per FAR 41.101, “utility service means a service such as furnishing electricity, natural or manufactured gas, water, sewerage, thermal energy, chilled water, steam, hot water or high temperature hot water.” It is estimated that the cumulative value of this contract shall be $ 19,000,000.00. The capacity for said Federal Buildings is as follows; Edward A. Garmatz U.S. Federal Courthouse (1,250 tons), George H. Fallon Federal Office Building (1,325 tons), U.S. Customs House (350 tons), U.S. Appraisers Store (350 tons) and SSA Metro West Federal Office Building (1,325 tons). This yields a cumulative required capacity of 4,700 tons which is a sizable amount of chilled water supply. The contractor shall be responsible for supplying chilled water service to the facilities without interruption, therefore adequate capacity to provide said utility service is paramount to determining suitability. Through mutliple methods of market research the Government was not able to identify suitable competition for this requirement and as such intends to issue a solicitation on a sole source basis. The statutory authority permitting other than full and open competition for this procurement is 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1, ‘Only one responsible source and no other supplies or services will satisfy agency requirements’. Per FAR 6.302-1 (b) (1), agencies are permitted to utilize this authority contingent upon a reasonable basis existing that the agency’s minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities.
