Description
This is a combined synopsis/solicitation forcommercial items prepared in accordance with theformat in Federal Acquisition Regulation (FAR) Subpart12.6, as supplemented with additional informationincluded in this notice. This procurement is beingconducted under Simplified Acquisition procedurespursuant to the authority of FAR Subpart 13 and FARPart 12, Acquisition of Commercial Items (Title VIIIof the Federal Acquisition Streamlining Act of 1994(Public Law 103-355)). This announcement constitutesthe only solicitation; therefore, a writtensolicitation will not be issued. The Bureau of IndianAffairs (BIA), Rocky Mountain Region (RMR) intends toaward a Firm-Fixed Price with economic priceadjustments, commercial item contract for theequipment listed in response to Request for Quotation(RFQ) RBC00080004 to acquire 1) TRANSPORTATION ANDDELIVERY SERVICES: Contractor shall be responsible forhauling an estimated 440 tons of CRS-2P Liquid Asphaltfrom a distributor in Laurel, Montana to the BIA RoadConstruction Job-site in Browning, Montana.Contractors submitting quotations should have thenecessary capability, resources, equipment andpersonnel to haul material an estimated sixteen (16)round trips of an estimated 30 tons per load it willtake to the construction job-site located 348 miles(one-way). Contractor shall also be responsible forproviding resources, equipment and personnel todistribute material, including a vehicle with anestimated capacity of 3,500 gallons or more it willtake to spray the material. 2) Contractors must have acurrent Commercial Drivers License; proof ofinsurance; Department of Transportation (DOT)vehicle(s) certification and inspection. 3) f.o.b.Destination to be delivered to the BIA RoadsConstruction Project on the Blackfeet IndianReservation in Browning, Montana. The solicitationdocuments and incorporated provisions and clauses arethose in effect through Federal Acquisition Circular2006-05. The associated North American IndustryClassification System code is 484230 and the smallbusiness size standard is $23.5 million. PRICESCHEDULE: The estimated procurement range for thisrequirement is under $100,000. Offers should besubmitted for ITEM 001: Price per ton (including allsurcharges). ITEM 002: Distribution (Spreader) Rate &Demurrage. ITEM 003: Fuel Surcharge percentage %. ITEM004: Mileage rate. ITEM 005: Per Diem (includinglodging, meals, etc). SUPERVISION: Works under thesupervision of the BIA, Division of Transportation,Billings, MT. Delivery shall be planned andcoordinated with the Division of Transportation.PERIOD OF PERFORMANCE: The contract shall be ineffect from the time of award until October 31, 2008,unless otherwise noted. GOVERNMENT FURNISHED PROPERTY,EQUIPMENT, SUPPLIES AND SERVICES: No Governmentfurnished property will be made available for thisrequirement. CONTRACTING OFFICER AUTHORITY: Authorityto negotiate changes in the terms, conditions oramounts cited in this contract is reserved for theContracting Officer. CONTRACTING OFFICERSREPRESENTATIVE (COR): The COR shall be responsiblefor: (1) Monitoring the Contractors technicalprogress, including surveillance and assessment ofperformance and recommending technical changes; (2)Interpreting the Specifications; (3) Technicalevaluation as required; (4) Technical inspections andacceptance; and (5) Assisting the Contractor in theresolution of technical problems encountered duringperformance of this contract. INVOICE SUBMISSION ANDPAYMENT: The Contractor shall submit its invoice tothe BIA Rocky Mountain Region, Branch of Accounting,James Battin Federal Building in Billings, Montana foracceptance and receiving. The Contractor agrees toinclude the following information on each invoice: (1)Contractors name, address; (2) Contract Number; (3)Invoice number and date; (4) Cost or price; (5) Datesof Service including the number of hours worked; and(6) Remit to address. Payment shall be made viaACH-Direct Deposit by the BIA-RMR Accounting Branch,316 North 26th Street, Billings, Montana 59101-1397. PRO-CHILDREN ACT OF 1994: The Contractor certifiesthat it will comply with the provisions of Public Law103-227, Pro-Children Act of 1994, which imposesrestrictions on smoking where Federally fundedservices are provided. CHILD CARE NATIONAL AGENCYCHECK AND INVESTIGATION (CNACI): For Equipment andSupply acquisitions, a CNACI will not be applicable.SPECIAL CONTRACT REQUIREMENTS: Contractors cannotserve as expert witnesses in any suit against theFederal Government. Many of the BIA customersreceiving services may only speak a native languageand/or reside on a Native American Reservation,therefore, the Contractor must demonstrate sensitivityto cross-cultural and language differences. PROVISIONSAND CLAUSES: The following provisions and clausesapply to this acquisition. The FAR provision 52.212-1Instructions to Offerors Commercial Items; 52.212-3Offeror Representations and Certifications CommercialItems are incorporated by reference; 52.216-27 Singleor Multiple Awards. The provision at 52.212-2 appliesto this acquisition and is provided in full text. FAR52.212-2 EVALUATION COMMERCIAL ITEMS (JAN 2004): (a)The Government may award a single or multiple contractresulting from this solicitation to the responsibleofferors whose quotation conforms to the solicitationand is most advantageous to the Government, price andother factors considered. Award will be made on thebasis of price and other factors representing the bestvalue to the government. A written notice of award oracceptance of an offer mailed or otherwise furnishedto the successful offeror within the time foracceptance specified in the offer, shall result in abinding contract without further action by eitherparty. The following FAR clauses are applicable:52.204-4, 52.204-7, 52.204-8, 52.212-4, 52.212-5,52.215-5, 52.216-27, 52.217-8, 52.217-9, 52.219-6,52.223-5, 52.223-6, 52.224-1, 52.224-2, 52.229-3,52.232-18, 52.237-2, 52.237-3, 52.242-15, 52.242-17,52.245-1 and 52.245-2. The following FAR clauses citedin 52.212-5 are applicable to the acquisition:52.203-6 with Alternate I, 52.219-8, 52.222-3,52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37,52.225-13, 52.232-33, 52.243-1, 52.246-17, 52.246-2,52.247-15, 52.247-34, 52.249-1 and 52.249-8. Offers shall besubmitted to the BIA Rocky Mountain Region,Acquisition Management, 316 North 26th Street,Billings, Montana 59101, no later than theclose-of-business on JUNE 18, 2008. The offer must besubmitted in a sealed envelope, addressed to thisoffice, showing the time specified for receipt, thesolicitation number, and your companys name andaddress.
