- This is a combined synopsis/solicitation for commercial items in accordance with Subparts 12.6 and 13.5 of the Federal Acquisition Regulation (FAR) as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested; a written solicitation shall not be issued. The National Oceanic & Atmospheric Administration (NOAA), a bureau of the U.S. Department of Commerce, seeks to secure a facility to conduct a public hearing in an informal adjudication currently being administered by NOAA's Office of General Counsel on behalf of the Secretary of Commerce on July 24th and 25th. A Statement of Work is set forth below. The resulting purchase order shall be awarded on a firm fixed price basis. The Government may award a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation shall be most advantageous to the Government. Quotes will be evaluated based on the factors set forth below. The factors, although relatively equal, are listed in order of importance. • Approach - The likelihood of effectively meeting requirements • Past Performance - The relevance and quality of prior performance • Price - The amount, realism, balance, and consistency of the evaluated price. The evaluation will be based on use of an adjectival scheme as follows: • Outstanding (O) - Conspicuously striking in eminence • Excellent (E) - Very good of its kind; eminently good, superior or first class • Good (G) - Beneficial and worthwhile; sound and valid • Adequate (A) - Reasonably sufficient and suitable • Marginal (M) - Minimally suitable at the lower limit • Unsatisfactory (U) - Not acceptable, not adequate to carry out The Government estimates that approximately $30,000.00 will be required for this work. The North American Industry Classification System (NAICS) code for this Request for Quotation is 531120 -- Conference center, no promotion of events, rental or leasing.. The North American Industry Classification System (NAICS) code cited in this Request for Quotation is for internal business size stratification purposes only and is not meant to restrict this procurement to small businesses. The solicitation document and incorporated clauses are those in effect through Federal Acquisition Circular Number 2005-26. The provisions and clauses may be downloaded at http://www.arnet.gov/far. The following provisions and clauses shall apply to this solicitation: FAR 52.212-l, Instructions to Offerors - Commercial, applies to this acquisition and there is no addenda to this provision; FAR 52.212-2, Evaluation - Commercial Items. The Government may award a purchase order resulting from this solicitation to the responsible offeror conforming to the solicitation which shall be most advantageous to the Government, price and other factors considered. FAR 52-212-3, Offeror Representations and Certifications - Commercial Items, applies to this acquisition and there are no addenda to this provision; FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition and there are no addenda to this provision; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition. All interested contractors shall be actively registered in the Central Contractor Registration (CCR) at the CCR website (www.ccr.gov). All responsible sources may respond to this combined synopsis/solicitation with a quotation emailed to Catherine Perren at catherine.a.perren@noaa.gov, to be received no later than 2:00 pm EST, June 23, 2008. Responses may also be faxed to 301-713-0806. The Government reserves the right to make a single award, multiple awards, or no award as a result of this RFQ. It is the responsibility of the contractor to confirm NOAA's receipt of quote. STATEMENT OF WORK Public Hearing in the Foothill/Eastern Transportation Corridor Appeal to the Secretary of Commerce under the Coastal Zone Management Act National Oceanic & Atmospheric Administration U.S. Department of Commerce This statement of work is submitted in support of a contract for a conference center needed for a public hearing in an informal adjudication currently being administered by NOAA's Office of General Counsel on behalf of the Secretary of Commerce. Background On February 15, 2008, Foothill/Eastern Transportation Agency (TCA) filed a notice of appeal with the Secretary of Commerce (Secretary), pursuant to section 307(c)(3)(A) of the Coastal Zone Management Act of 1972 (CZMA), 16 U.S.C. § 1456(c)(3)(A). TCA appealed an objection by the California Coastal Commission to the construction of an extension to California State Route 241 in northern San Diego and southern Orange Counties, California. Under the CZMA, the Secretary may override the Commission's objection on grounds that the project is consistent with the objectives or purposes of the CZMA or otherwise necessary in the interest of national security. NOAA's Office of the General Counsel administers the appeal on behalf of the Secretary. The Secretary has 160 days from the date of publication of the notice of appeal in the Federal Register in which to close the decision record for the appeal. 16 U.S.C. § 1465(b). Within this time frame, the Secretary must: (a) compile all relevant documentation; (b) obtain briefs from the parties; and (c) where appropriate, obtain comments from interested federal agencies and the public - including public hearings. This 160-day time frame may be extended for no more than 60 days. Upon request or upon his own initiative the Secretary may hold a public hearing. 15 C.F.R. § 930.128 (d). When a hearing is held, the Secretary must provide the parties with at least 30 days notice of the time and place set for the hearing, and the public comment period must remain open for at least 10 days after the hearing. Id.; see also 15 C.F.R. § 930.113(a). On May 21, 2008, the General Counsel of NOAA, on behalf of the Secretary of Commerce, issued an order granting a public hearing. Purpose It is necessary to hold the public hearing in the next six to eight weeks in order to complete the public hearing and the subsequent comment period (and any necessary follow-up procedures) before the record closes in this appeal on August 25, 2008. The closure of the decision record is a strict statutory deadline, and, due to recent amendments to the CZMA the Secretary is limited in his ability to extend this deadline. Once the record is closed the opportunity to react to comments received during the public hearing will be lost. Further, by regulation, the Secretary must provide at least 30 days notice of the time and place set for the hearing. 15 C.F.R. § 930.113. Scope: This statement of work is limited to one hearing spanning up to two days Capabilities: NOAA's Office of General Counsel has determined the following parameters are necessary for the selected hearing venue. The facility must: 1) be located within 35 miles of the intersection of Interstate 5 and Camp Pendleton Marine Corps Base, 2) have reasonable costs, 3) have capacity for 3,000 to 5,000 people, 4) be available on July 24 and July 25, 2006, 5) have parking nearby, 6) have public transportation nearby, 7) be located in close proximity to airports and hotels, and 8) be air conditioned. Period of Performance: The hearings in this appeal will be held on July 24 and July 25, 2008.
