Description
The Department of Veterans Affairs Central Office (VACO) intends to issue a sole source contract to TSI Incorporated, St. Paul, MN for the following equipment:PortaCount Pro+Respirator Fit Tester, # 8038, 65 each; and Fit Test Proble Refill Kit for 8025-N95, 65 each. This notice of intent is not a request for quotes. The Government intends to acquire the supplies via FAR 6.302-1 and FAR Part 12. Interested organizations may submit descriptive literature containing sufficient literature to the extent necessary to allow the government to determine the technical acceptability of specification. The aforementioned information should be submitted in writing to the Contract Specialist (email: Priscilla.Lee@va.gov) not later than 2:00 p.m. local time on July 7, 2008. Oral communications are not acceptable in response to this notice. Please reference RFQ #VA-101-08-RQ-0217. NAICS #339113. Below is the Justification for the aforementioned supplies, in accordance with FAR 11.105: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using other than full and open competition, pursuant to the authority cited herein. 1. Identification of Agency Department of Veterans Affairs Office of Acquisition and Logistics Center for Acquisition Innovation (049A1) 810 Vermont Avenue, NW Washington, DC 20420 2. Nature of Action Being Approved: This document sets forth the facts and requests approval for the issuance of a contract to TSI Incorporated, St. Paul, MN for TSI PortaCount direct reading fit testing units to support medical facilities within the Veterans Health Administration (VHA). Respirator fit testing is mandated under OSHA 29 CFR 1910.134. The proposed price is $674,129.14. 3. Description of Service and Supplies: The TSI PortaCount is a direct reading fit testing unit for determining if a respirator or mask correctly fits the user's face and provides adequate protection from harmful particulates. The unit streamlines the OSHA fit test protocol to a series of timed exercises (breathing, deep breathing, at rest, etc) providing a visual pass/fail score. The unit detects leakage of the face piece mask by comparing the particle count inside and outside the mask. This unit replaces a lengthier fit test procedure that involves subjecting the employee to a corrosive atmosphere. This equipment is safer, faster, and the standard in the industry. 4. Statutory Authority: The statutory authority for this justification is 10 U.S.C. 2304 (c) (1) or 41 U.S.C. c(1) and FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. 5. Justification Rationale: TSI is the sole source for nuclei condensation counting using ambient air particles for comparing concentrations inside and outside the mask with calculation of respiratory protection factor while the employee is wearing the actual respirator. No other company offers this technology, and it is considered the defacto method to meet the OSHA requirement. The TSI PortaCount is the only type of equipment that VAMCs have been purchasing for the past 10 years to meet OSHA quantitative fit testing requirements. The number of staff requiring respiratory protection will greatly increase during a SARS/Pandemic flu event, thus we require additional units to ensure that our facilities will be prepared in the event of an emergency.
