Description
SECTION C - SPECIAL CONTRACT REQUIREMENTS DESCRIPTION/SPECIFJCATIONS/STATEMENT OF WORK CONTRACT REQUIREMENTS I.Nursing home care will be furnished to beneficiaries for whom such care is specifically authorized by the Department of Veterans Affairs. It is understood that the type of patients to be cared for under this contract will normally not require more than occasional visits by physicians or more than minimal laboratory, X-ray, and other special services. The care provided will include room, meals, nursing care, and any other services or supplies normally provided other patients in the nursing home without extra charge. In addition, the per diem rate established in this contract will include the cost of medical care, emergency dental care, drugs, laboratory, X-ray, and other necessary services, unless otherwise specifically excepted in this contract. It is further agreed that patients receiving care under this contract who begin to require more than occasional visits by physicians or more than minimal laboratory, X-ray, and other special services will be promptly readmitted to an appropriate Department of Veterans Affairs facility. Every effort shall be made to keep the patient ambulatory. 2.Absences of the patient from the nursing home in excess of 48 hours will not be reimbursable except with the prior approval of the MAS Officer. 3.In the event a beneficiary receiving nursing home care under this contract dies, the nursing home will promptly notify the Department of Veterans Affairs office authorizing admission and immediately assemble, inventory, and safeguard the patients personal effects. The funds, deposits, and effects left by Department of Veterans Affairs patients upon the premises of the nursing home shall be delivered by the nursing home to the person or persons entitled thereto under the laws currently governing the nursing home for making disposition of funds and effects left by patients, unless the beneficiary died without leaving a will, heirs, or next of kin capable of inheriting. When disposition has been made, the itemized inventory with a notation as to the disposition of the funds and effects will be immediately forwarded to the Department of Veterans Affairs office. Should a deceased patient leave no will, heirs, or next of kin, his personal property and funds wherever located vests in and becomes the property of the United States in trust. In these cases the nursing home will forward an inventory of any such property and funds in its possession to the appropriate Department of Veterans Affairs office and will hold them (except articles of clothing necessary for proper burial) under safeguard until instructions are received from the Department of Veterans Affairs concerning dispositionS 4.It is agreed that the nursing home will notify the authorizing VA hospital immediately when a medical emergency requiring rehospitalization occurs. It is agreed that the veteran will be readmitted to an appropriate VA facility. When such readmission is not feasible because of the nature of the emergency, it is agreed that hospitalization in a non-Federal hospital may be accomplished provided VA authorization is obtained. Ifhospitalization of a non-emergency nature is required, it is agreed that readmission to the VA hospital will be accomplished promptly. 5.The nursing home agrees and warrants that it does not maintain nor provide dual or segregated patient facilities which are segregated on the basis of race, creed, color, or national origin. The nursing home may neither require such segregated use by written or oral policies nor tolerate such use by local custom. The term facilities shall include but not be limited to rooms, wards, sections, eating areas, drinking fountains, entrances, etc. It is agreed that the Department of Veterans Affairs will have the right to inspection of the nursing home and all appurtenances by an authorized representative(s) designated by the Department of Veterans Affairs, to determine whether acceptable standards are maintained and that adequate care is being rendered, 6.The nursing home agrees to accept referral of and to provide all services,specifled in thuis contract for any person determined eligible by the Chief Medical Director or: his designee, regardless of the race, color, religion, sex or national origin (unless otherwise indicated in Part I, Item 11) of the person for whom such services are ordered. In addition the nursing home warrants that subcontracting will not be resorted to as a means of circumventing this provision. 7.It is agreed that the VA may readily, have access to all medical records concerning the veterans care in the nursing home. It is agreed that duly authorized representatives of the VA will provide follow-up supervision visits to veterans placed to assure the continuity of care and to assist in the veterans transition back into the community. It is understood that these visits do not, substitute nor relieve the nursing home in any way of the responsibility for the daily care and medical treatment of the veteran. Upon discharge or death of the patient, medical records on all VA beneficiaries will be retained by the nursing home for a period of at least three years following termination of care at VA expense. 8.It is understood that the beneficiary may be provided nursing home care at the expense of the Department of Veterans Affairs for a period not in excess of that stated in the nursing care and treatment plan received from the Department of Veterans Affairs, unless an extension of the authorization is provided in writing by the appropriate VA station. 9.It is agreed that the nursing home will submit VA Form IO-1204b, Report of Nursing Home Care, to Chief Fiscal, VA Medical Office Center, White River Jct., VT 05009, along with invoice monthly for beneficiaries receiving care under this contract. 10.It is understood that payments made by the VA under this contract will constitute the total cost of nursing home care. The nursing home agrees that no additional charges will be billed to Medicaid, Medicare, the beneficiary or his family, either by the nursing home or any third party furnishing services or supplies required for such care, unless and until specific prior authorization in writing is obtained from the VA facility that authorized placement. 11.The nursing home warrants that all applicable fire laws are being complied with and there are no recommendations of fire officials which have not been resolved, 12.It is impossible to determine the exact or estimated amount which will be expended under this contract. It is understood that no obligation will be incurred by the VA under this contract until authorizations are issued for nursing home care of specific beneficiaries. The VA agrees to make payment on a timely basis for services rendered in accordance with such authorizations upon receipt of billings submitted by the nursing home at the completion of each months services. If a beneficiary is admitted to and discharged from the nursing home on the same calendar day, payment will be made for one day. Invoices shall be submitted the VA facility authorizing admission of the patient. ~3. The following additional VA Standards apply for nursing services for intermediate care facilities: a.The Nursing Service is under the direct supervision of a full-time (40 hours) professional nurse, currently licensed to practice in the State. b.There is at least one registered professional nurse or licensed practical nurse or vocational nurse (a graduate of a State-approved school of nursing) on duty and in charge of nursing activities during each tour of duty. c.Provision is made for appropriately trained personnel to relieve during vacation, sick leave, and other periods of emergency to assure 24-hour coverage. C.l CONTRACT TYPE This is an basic ordering agreement in accordance with FAR 16.7. A contract is formed for the quantities stipulated in Section C of this contract upon the signatures of the authorized officials for VA and the nursing home. C.2TERMINATION OF SERVICES VA reserves the right to remove any or all VA patients from the nursing home at any time, when it is determined to be in the best interest of VA or the patients. C.3EXTENSION OF AGREEMENT This agreement may be extended for four - one year periods at the option of the Government in accordance with 52.2 17-9, Option to Extend the Term of the Contract. Notice of an extension must be served in writing by the Government thirty days prior to the scheduled expiration date. The extension is granted subject to the availability of funds. C.4PAYMENTS Payments made by VA under this contract constitute the total cost of nursing home care. No additional charges will be billed to Medicare Part B, the beneficiary or his/her family, either by the nursing home or any third part furnishing services or supplies required for such care, unless and until specific prior authorization in writing is obtained from the VA facility authorizing placement. The contractor will not solicit contributions, donations, or gifts from patients or family members. C.5ACCEPTABLE SAFETY AND SANITATION PRACTICES Acceptable safety and sanitation practices shall be observed throughout the facility. The buihding shall conform to the standards of the Life Safety Code (National Fire Protection Association Standard ~10I) in effect on the date of contract award. C.6MINIMUM QUANTITIES It is impossible to determine the exact or estimated amount which will be expended under this coiitract. No obligation will be incurred by VA under this contract, except for the minimum quantity stipulated herein, until authorizations are issued for nursing home care of specific beneficiaries. VA agrees to make payment on a timely basis for services rendered in accordance with such authorizations upon receipt of proper invoices submitted by the nursing home as outlined in Section E of this contract. VA will make payment for the day a recipient enters the facility but not the day the recipient leaves a facility unless entrance and departure are on the same day then payment will be made for one day. C.7MEDICARE/MEDICAID STANDARDS The contractor is required to follow Medicare/Medicaid standards for all VA placements, except Life Safety. Medicare and Medicaid clinical and program standards are found in 42 CFR 483. The VA does not accept waivers from nursing service standards.
