Description
1. Title of Project: VHA Health Administration Center Office of Business Oversight Compliance Review - Contracting Functions ("OBO Compliance - Contracting"). 2.a. Overview of Project: The VHA Health Administration Center ("HAC") Office of Business Oversight ("OBO") is responsible for the implementation of the internal oversight and controls and compliance program for the Health Administration Center, including ensuring that HAC Divisions attain and maintain full compliance with federal law and regulations, VA regulations and directives, and Chief Business Office and HAC policies. The HAC is part of the VHA Central Business Office. The Contracting Section of the HAC Logistics Division must perform acquisition and procurement functions, including contracting and purchasing, in accordance with federal laws and regulations (Federal Acquisition Regulations - FAR and VA Acquisition Regulations - VAAR), fiscal management laws and requirements, and in compliance with VA and CBO/HAC policies. In addition, these functions should comply with best business practices whenever possible. This Section conducts acquisitions for the Central Business Office and its components including the HAC, the Health Eligibility Center (HEC), and Health Revenue Center (HRC). The OBO is a new unit of the HAC, which must now establish and later audit the compliance criteria and status of critical functions, including contracting and procurement. b. Type of procurement: The HAC will solicit holders of Federal Supply Schedules under Category 874-1, Mission Oriented Business Integrated Services, with a 100% set-aside for Service-Disabled Veteran-Owned Small Businesses. 2. Statement of Objectives: The Contractor shall provide research, analysis, assessment and planning services to 1) compile the compliance requirements for the Contracting Section, 2) record and describe the current compliance status of contracting functions and the Section, and 3) recommend steps and actions to attain full compliance and best practices. a.(1) Major objective 1: The Contractor will research and identify the compliance requirements of the HAC Contracting Section. The areas of research would include but not be limited to: 1) certification and warrants of contracting officers; 2) training of purchasing agents; 3) statutory requirements for contracting officers and purchasing agents; 4) Federal Acquisition Regulations and Veterans Affairs Acquisition Regulations requirements for: a) contracting officers and purchase agents; b) methods of acquisition; c) application to acquisitions, including - i) micro-purchases; ii) Simplified Acquisition Procedures; iii) acquisition of commercial supplies and services; iv) acquisition of non-commercial items; d) application of fiscal law requirements; e) processes for internal Section reviews; f) processes for internal HAC and CBO reviews; g) VA Central Office legal, technical and business reviews and compliance requirements. 5) CBO and HAC policies and controls for acquisitions and procurement. a.(2) Deliverable 1: The Contractor will develop and provide a detailed checklist of compliance criteria, standards, and requirements for the HAC contracting functions. The checklist must be sufficient to enable the HAC OBO to conduct future audits of compliance of the Contracting Section. b.(1) Major objective 2: The Contractor will research, analyze, and assess the current compliance status of the HAC Contracting Section, and assess the current plan and efforts underway for attaining compliance, including compliance with URAC standards. 1) The Contractor will be provided access at the HAC to necessary HAC systems including VistA to review contracts for local and delegated requirements compliance. 2) The Contractor will be provided access at the HAC to Federal Acquisition Institute ACMIS database to review contracting officers', contracting officers' technical representatives', and purchasing agents' certifications and warrants. 3) The Contractor will be provided access at the HAC to the VA eCMS contract management system for audit of contracts. 4) The Contractor will be provided access at the HAC to documents and files as necessary. b.(2) Deliverable 2: The Contractor will review a meaningful sample of procurement actions of various types in order to determine and report in detail the compliance status of the Section compared to the checklist of applicable compliance criteria, standards, and requirements. c.(1) Major objective 3: The Contractor will analyze the gaps between the current compliance status of the HAC Contracting Section and the checklist of compliance criteria, standards, and requirements. The Contractor will also analyze the status of the Section in meeting "best practices" criteria and the gaps between current plans and efforts and the required compliance status. c.(2) Deliverable 3: The Contractor will recommend a compliance plan for attaining full compliance with required standards and best practices applicable to the contracting functions. 4. Performance Period: The HAC anticipates a performance period of approximately 60 days after commencement. The Contractor shall not commence performance on the tasks in this SOW until the Contracting Officer has conducted a kick off meeting or has advised the Contractor that a kick off meeting is waived.
