Description
The VA Boston Healthcare System intends to negotiate and procure on a sole source basis the supply of Spider Filters, Vessel Tips in different sizes, from EV3, Inc. located in Minneapolis, MN. This procurement is being conducted under FAR 6.302-1, only one responsible source and no other vendor or product will satisfy agency requirements. To the best of our knowledge EV3, Inc. is the only authorized distributor of these kinds of filters and tips. This notice of intent is not a request for competitive quotes. No solicitation document is available and telephone requests will not be accepted. However, any firm that believes it can meet these requirements may give written notification to the Contracting Officer within five (5) calendar days from the date of publication of this synopsis. Supporting evidence must be furnished in sufficient detail, to demonstrate the ability to comply with the above requirements. This information can be faxed to Christine Gorman at 774-826-3347. Responses will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Post in FBO today for 5 days i.e. 7/10/2008 14:00 pm EST Deadline 7/15/2008 14:00 pm EST JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of (1) the agency and (2) the contracting activity: (1) VA Medical Center, Surgical Service, West Roxbury, MA (2) Acquisition and Material Management Service 940 Belmont Street Brockton, MA 02301 2. Nature and/or description of the action being approved: This documentation is to support sole-source award for Spider FX Filters, Vessel Standard Tips, and Silverhawk Sheaths TO EV3. 3. Description of the supplies or services required to meet the agency's needs (including the estimated value): These surgical supplies are necessary performing the vascular procedure(s). These specific items are prescribed by the vascular physicians who used them as a guide for protection to contain and remove embolic material. Furthermore, they are also used to remove plaque that blocks arteries and interrupts blood flow. These devices ensure the high success rate of vascular procedure(s). 4. Identification of the statutory authority permitting other than full and open competition: FAR 6.302-1, 41 USC 253(c)(1) Only One Responsible Source 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority sited: 1. These devices were approved by FDA recently. 2. EV3 is the only source that provides these devices. 3. The Silverhawk will allow physicians to treat patients more efficiently in plaque removal procedures. This will help the patients suffering from PAD. 4. These devices and accessories allow a traumatic lesion crossing with any 0.014 or 0.018 guidewire of choice vs fixed wire system. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be published: An intent to sole-source notice will be published on the Federal Business Opportunities (FedBizOpps) website. Due to the nature of the work required and the time constraints, it is in the governments best interest to negotiate and anticipate award to the proposed contractor, EV3, Inc. 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The anticipated cost of this requirement is approximately $58,000.00. A more detailed price analysis will be performed prior to award. 8. Description of the market survey conducted (i.e., names, of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. Review of the GSA schedule indicates there is no other supplier for these kinds of devices. 9. Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. See factor number 5 for a complete description of the technical nature of this requirement. See factor number 11 for future requirements. The Silverhawk catheters are a device used to remove plaque that blocks arteries and interrupts blood flow. Unlike other methods of restoring blood flow, these devices remove the obstruction of plaque buildup, instead of simply compressing it against the vessel wall. No other company can offer this type of device. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. N/A. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The contracting activity will continue to monitor the availability of these specific devices from other vendors.
