- Statement of Work – Fitness Center October 1, 2008 through September 30, 2009 The Office of Justice Programs, (OJP) will establish a program to promote and maintain the physical and mental fitness of OJP employees, as authorized by 5 U.S.C. section 7901, and to partially fund fitness center memberships for OJP employees. 1. Agency Requirements Membership dues will remain at the negotiated rate per month for the 12-month period beginning on October 1, 2008.  OJP will pay one-half the individual membership cost for each permanent OJP employee.  OJP employees are responsible for payment of the balance per month.  Federal employees detailed from other federal agencies for a period of more than 6 months are considered to be OJP employees and may join the fitness center under the same provisions as permanent OJP employees for the duration of their detail.  If an OJP employee joins the fitness center after the 14th day of any month, OJP will not be charged the subsidized portion of the membership dues; however, the OJP employee is responsible for paying their share of the membership fee for that month.  A flat rate is required for Interns, volunteers, and stay-in-school students, etc., who work on a temporary basis during the summer at OJP. They will be responsible for payment of their entire membership rate.  Temporary employees, with a term of employment greater than 120 days, are considered permanent OJP employees for the length of their employment and are not eligible for the flat membership rate, but rather join under the same provisions as permanent OJP employees. 2. The Fitness Center Agrees to the Following Terms of Membership In order to participate in this agreement:  OJP employees (permanent and temporary) must obtain a ‘Certification of Eligibility’ from the Support Services Division (SSD), Office of Administration, OJP, and present this certification to the fitness center to establish a membership contract.  Upon establishment of the membership contract, OJP employees will obtain a fully executed copy of the employee’s contract with the fitness center to facilitate and validate payments made by OJP for one-half the membership dues.  Membership dues payments to the fitness center by OJP will only be made for employees with signed contracts with the fitness center on file with the SSD agency representative by the end of the month in which the contract is executed. If the OJP employee fails to return a fully executed copy of the signed contract the employee will be responsible for full payment. 3. Termination of Individual Membership  Individual memberships may only be terminated during the agreement for medical reasons, retirement, and change of employment, reassignment or change of transportation and must have the approval of the SSD agency representative.  The request for termination must be presented to the fitness center in writing. The employee should use the form letter which can be obtained from the SSD agency representative.  If an employee terminates membership between the 1st and10th of a month, OJP and the employee will not pay for that month.  If termination occurs between the 11th and the end of the month, OJP and the employee will pay for that month.  Individual memberships may be put on hold ‘frozen’ with the approval of the SSD agency representative. OJP will not be responsible for payment of any account that has a ‘freeze’ in place. 4. Period of Agreement This agreement will be in effect from October 1, 2008 through to include September 30, 2009. All memberships will be effective from the initial start date of employee's contract through expiration of this SOW. 5. Invoicing Requirement  The Fitness center will invoice OJP for the monthly membership dues for the subsidized portion for each employee.  The invoice will list the number and names of employees with current contracts, the date the employees executed their contracts, and the total cost. The invoice will be validated by SSD agency representatives before authorized for payment.  Employees will be electronically charged (via credit card or checking withdrawal) each month for their portion of the membership dues. 6. Liability  OJP assumes no liability for employees’ usage of the fitness facility.  Each employee's membership contract is directly with the fitness facility.. 7. In your response please identify the following:  Hours of operation.  Type of equipment used in the fitness center.  Services offered.  Classes offered (beginner level classes as well as advanced level classes).  If lockers are available.  If personal trainers are available.  If parking is available.  If there is a pool on location (type of pool; i.e.: lap, endless, leisure)  If showers including towels are available Also, please list any ancillary fees associated with these services. The fitness center must be within a ten minute walking distance of the following location: Office of Justice Programs, 810 7th Street, NW, Washington, DC 20531. All interested parties must express their interest and capabilities in writing to OJP, 810 7th Street, NW, Room 3619, Washington, DC 20531, Attn: Reginald A. Lee, by facsimile at (202) 307-0086 or by email at Reginald.lee@usdoj.gov by September 1, 2008. Documents over 10 pages in total will not be accepted by facsimile. Verification of receipt of fax and email transmission is the sole responsibility of the contractor.
