- NAICS Code: 811219 The U.S. Environmental Protection Agency (EPA) intends to negotiate a sole source purchase order under the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures with Affymetrix, Inc., 3420 Central Expressway, Santa Clara, CA 95051.The purpose of this purchase order is to acquire maintenance services for a Affymetrix System 3000 with Autoloader for the period of August 1, 2008 through July 31, 2009. Under this purchase order, the vendor shall provide a assurance agreement includes but not limited to the following services: 1)Technical Support Phone Coverage: Monday - Friday 8 AM - 5 PM excluding holidays, 2) Telephone Response: 4 hours or less, 3)On-site Response to Service Request: 48 hours or less: 4) Emergency Visits: Unlimited, 5) Parts included: Unlimited, 6) Preventative Maintenance Visits: One, 7) Software Upgrade: Affymetrix Inc. has exclusive copyrights, patents, and/or trade secret ownership; and, therefore, is the only vendor that can satisfy the requirement. In order to ensure correct instrument operation, the circumstance permitting is FAR 13.106(b) (1) "only one source reasonably available". The intent of this notice is to determine if any other source(s) exist; and, therefore, no solicitation (RFQ) is available. Consequently, any response failing to demonstrate the contractor's ability to provide maintenance of the instrument and instead choosing merely to submit a routine letter requesting a copy of the RFQ will be ignored. The information received in response to this notice will be considered solely for determining whether to conduct a competitive procurement. Interested parties may submit written qualification statements, fully explaining their capability, no later than 10 days after the date of this publication.
