- Description
- The U.S. Army Space and Missile Defense Command on behalf of the Critical Reagents Program (CRP) intends to negotiate on a sole source basis with Battelle Memorial Institute (Battelle) for a 3-month, firm-fixed-price contract. The purpose of this acquisition is to fulfill Joint Biological Point Detection Systems (JBPDS) requirements for carrier box assemblies (CBAs) to support both CONUS and OCONUS operations, as well as Foreign Military Sales. JBPDS is is intended to detect the presence of airborne Biological Warfare Agents (BWAs) and identify the type of agent where the system is deployed. BWA detection depends on the detection capability of immunoassay strips found inside the JPBDS CBA. The CRP is currently the provider of JBPDS CBAs; San Antonio Scientific, previously the supplier of the immunodetection strips used in JBPDS CBAs produced by Battelle, is now contracted as the sole production facility for JBPDS carriers. The contract with Battelle will fulfill an interim requirement for JBPDS CBAs pending award of a competitively awarded contract. If JBPDS CBAs are not acquired from Battelle then more than 300 JBPDS fielded CONUS, OCONUS, and U.S. allies sites will be unable to protect the warfighter and the nation from BWA attack. This contract action shall be issued usinig the statutory authority permitting acquisition of these items by other than full and open competition detailed in 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2(a)(2), which specifies that full and open competition is not necessary when the agency's need for the supplies or services is of such an unusual and compelling nature that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Due to the specialized nauture of building the JBPDS CBAs it would take an unacceptable amount of time and cost to stand up the new production facility. The need for JBPDS CBAs is immediate and can only be fulfilled by Battelle.. This is not a request for competitive proposals. Parties purporting to have the requisite credentials to perform these services without unacceptable delays in fulfilling the agency's requirements must respond by 25 July 2008, and furnish, in writing, factual information, which clearly supports and demonstrates that their facility is sufficiently able to produce quailified JBPDS CBAs. A determination not to compete this proposed action based on any responses to this notice is solely within the discretion of the Contracting Officer.
