- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The reference number is H92241-08-R-0031 and this solicitation is issued as a request for proposal (RFP). This RFP does not provide for full and open competition. Justification for Other Than Full Open Competition is FAR 6.302-1, 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The solicitation document and incorporated provisions and clauses are in effect through Federal Acquisition Circular 2005-25, effective 28 Feb 2008. The associated NAICS code is 332994 and small business standard is 1000 employees. The government intends to purchase the M134D-T Mini-Gun, Titanium, P/N M134D-T, NSN 1005-01-551-3046 and spare parts. The intended source is Dillon Aero, Inc. 8009 E. Dillons Way, Scottsdale, AZ 85260. Dillon Aero is the only source that has the specifications and technical knowledge required to manufacture Minigun and associated parts. The Government intends to establish a Blanket Purchase Agreement (BPA) with Dillon Aero Inc. as a result of this announcement. The BPA will expire five (5) years after award. Individual purchases are limited to $5,500,000.00 or less, with a BPA dollar limit of $25,000,000.00. All parts shall be delivered to the Lexington, KY TAPO Warehouse, unless otherwise stated. The delivery schedule will be determined prior to each BPA call. FOB and Acceptance/Inspection is at origin by a Government quality assurance representative (QAR), unless otherwise stated. The Government is obligated only to the extent of authorized purchases actually made under each BPA call. A list of individuals authorized to purchase under the BPA, identified by name of individual, organizational component, and the dollar limitation per purchase for each individual will be furnished to the provider by the contracting officer. The following provisions and clauses are applicable to this procurement: 52.212-1, Instructions to Offerors-Commercial; 52.212-3, Offeror Representations and Certifications-Commercial Items (Offerors are instructed to complete this section and return with their quote); 52.212-4, Contract Terms and Conditions-Commercial Items; and all applicable clauses required by 52.212-5, Contract Terms and Conditions Required to Implement Statutes or executive Orders-Commercial applies to this acquisition contingent upon the dollar value. The following DFAR clauses cited are applicable to this acquisition: 252.204-7004, Required Central Contractor Registration; 252.211-7003, Item Identification and Valuation; 252.212-7000, Offeror Representations and Certifications-Commercial Items; 252.232-7003, Electronic Submission of Payment Requests; and all applicable clauses required by 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items contingent upon the dollar value of the acquisition. The Defense Priorities and Allocation Systems (DPAS) assigned rating for this procurement is DO-A1. Interested parties should respond via e-mail no later 4:00p.m. EST. on 4 August 2008.
