Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition Procedures pursuant to the authority of FAR Subpart 13.5, Test Program for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), FAR 37.101, Nonpersonal Services Contract, and FAR 37.6, Performance-Based Acquisition. This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a non-personal service, Indefinite Delivery Indefinite Quantity (IDIQ) commercial item contract in response to Request for Quotation (RFQ)-10-08-049-REL. The quantities specified in the Price Schedule are estimates only and are not purchased by this contract. Performance shall be made only as authorized by written orders in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the services specified in the Price Schedule up to the "Maximum" quantity. The Government shall order at least the "Minimum" quantity of services designated in the Price Schedule. The services are being solicited on an unrestricted basis. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. The associated North American Industry Classification System code is 561311 and the small business size standard is $6.5 million. PRICE SCHEDULE - RECRUITMENT SERVICES: The price schedule, vacancies and vacancy rates for each category and IHS Service Unit are attached. A minimum of 12 positions to a maximum of 16 positions shall be filled each year. PURPOSE OF THE CONTRACT: The mission of the Billings Area Indian Health Service (IHS) is to provide the best possible health care services to the Native American populations on the Indian Reservations throughout the States of Wyoming and Montana. In order to achieve this mission, IHS intends to contract with a recruitment company to assist with the recruitment and referral of qualified health professionals including, but not limited to, physicians, nurse practitioners, physician assistants, clinical psychologists, dentists, pharmacists, medical technologists and nurses for possible hire. STATEMENT OF WORK: (1) The overall scope of this contract is to recruit and refer qualified health professionals for possible hire as permanent employees in the Billings Area Indian Health Service. The referred health professional will be expected to have the necessary education, training, licensing, previous work experience and competence to qualify and be considered for permanent hire at hospitals and clinics in the Billings Area. Depending on the hospitals/clinics needs, pharmacists, medical technologists, mid levels, nurses and board eligible or board certified physicians will be recruited in the specialties of family practice, internal medicine, pediatrics, OB/GYN, emergency medicine, podiatry, and general surgery. LOCATIONS OF HOSPITALS: Browning and Crow Agency, Montana; LOCATIONS OF HEALTH CENTERS: Harlem, Poplar, Wolf Point, Lame Deer, Montana; and Fort Washakie and Arapahoe, Wyoming. (2) The contractor shall provide search, recruitment, and prescreening for health professionals to work at the Service Units within the Billings Area Indian Health Service. The contractor shall refer to the Billings Area Indian Health Service only those candidates from who the firm has not accepted fees. (3) The contractor shall screen candidates against the basic qualification requirements for the positions specified by the Billings Area Indian Health Service, and refer to the BAO, all candidates who appear to meet those requirements. The contractor will submit a packet on the referred candidates. This packet is to include: a resume that must account for all work experience since completion of education/training, including explanation of gaps over 30 days. Initial credential checks must be performed on potential candidates prior to referrals and documented as part of the submission package of a physician. Referred candidates must be U.S. Citizens. Candidates applying for permanent employment must pass HHS' required background investigation (CNACI) and the Child Care National Agency Check. (4) The candidates must be available for permanent placement within 60 days of official job offer by Human Resources. Salary is commensurate with experience and will be determined by the Billings Area Indian Health Service. Contractor will be paid 50% upon candidate accepting the position and 50% on the first work day (or upon credentialing and licensing). (5) The contractor will verify credentials and obtain professional references for each candidate submitted to the Billings Area Office. The contractor will verify that the physician is not listed on the HHS OIG Exclusionary List (LEIE). The positions require that employee obtains clinical privileges. If they are not obtained or maintained during employment, the employee may be subject to adverse actions, up to and including removal from the Federal Service. (Reference: Billings Area Indian Health Service Circular No. 02-01, dated 1/7/02, Medical Staff Credentialing). (6) The contractor will initiate another search in the event that a placed candidate fails to commence practice or is terminated by the Billings Area Indian Health Service for any reason within one calendar year from the effective start date at no additional cost to the government. If, for any reason within one calendar year of the date employment began and an additional candidate cannot be found, the contractor shall issue any and all refunds due to the Billings Area Office within 14 calendar days of notification that a refund is due. (7) The contract is prohibited by law from charging a fee to individuals referred for Federal positions. (8) The contractor shall provide a copy of all IHS specific position search announcement/advertisements (which are to be posted in any form such as web, printed, etc.) to the Project Officer prior to publication to insure accuracy and compliance with advertising policies. All announcements/advertisements placed by the contractor for an IHS position must contain the statement "The IHS is an Equal Opportunity Employer". (a) Advertisements could also include "Excellent benefits package for FT/PT staff including competitive pay scales, 13 days per year vacation, 13 days per year for sick leave, choice of health insurance plans, life insurance, retirement plan, optional tax-deferred savings plan with matching funds. (b) The practitioner selected may be eligible to apply for the Loan Repayment Program. The Loan Repayment Program will repay all or a portion of the applicant's eligible health professional education loans. (c) Shipment of household goods and personal belongings are covered up to 18,000 pounds. Applicants must sign a one-year employment agreement before their household goods shipment is authorized. (9) The Indian Health Service will comply with the following procedures in regards to employment: (a) If the practitioner is considered for permanent employment, he/she will be evaluated and appointed through regular civil service employment procedures and through the medical staff credentialing and privileging process. (b) IHS will provide the same consideration for candidates who have applied directly to the IHS Human Resources Office as well as those referred from the commercial recruiting firm or nonprofit employment service. (c) The IHS will follow all IHS requirements for appointment including Indian Preference, where applicable. The Indian Health Service (IHS) by law is committed to affording employment preference to American Indian and Alaska Native candidates who meet the Secretary of the Interior's definition of Indian for appointment to vacancies within the IHS in accordance with established IHS policy as outlined in the Indian Health Manual Part 7, Chapter 3. In other than the above, the Indian Health Service is an Equal Opportunity Employer. (10) Deliverables: Vacancies and vacancy rates for each category at each Service Unit are attached. The minimum requirement for the Contractor is to fill at least six vacant positions with 6 qualified candidates every six months for all of the Billings Area. Priority will be placed with those Services Units and categories that have vacancy rates of greater than 30%. Deductions will apply if the minimum requirement is not met or if priority areas are not filled. The contractor will be paid when referred candidate(s) is/are hired by Indian Health Service. Contractor will be paid only for those candidates the contractor has recruited and referred to the Billings Area Office. The candidate must remain in service at least one (1) year. PERIOD OF PERFORMANCE: The performance of this contract shall be for a 12-month period with four 12-month options. PERFORMANCE-BASED SERVICE DELIVERY SUMMARY: Performance will be measured based on the following Performance Requirements: (1) Quality of Candidates Referred; (2) Productivity; (3) Priority Areas; (4) Retention of Candidates; and (5) Timeliness of Placement. The Performance Requirements will be measured against the following Government Performance Standards: (1) Qualifications required under each category; (2) Number of candidates to be hired within a 6 month period of time; (3) Areas of priority will include those services and categories of vacancy rates of greater than 30%; (4) Length of time that candidate remains with the Service Unit; and (5) As specified in the Performance Work Statement. The Method of Government Surveillance to determine compliance with the Performance Requirements are as follows: (1) Review number of referred candidates that meet qualifications of profession in order to be placed on the roster; (2) Review of candidate referred every 6 months; (3) Each vacancy filled; (4) Number of candidates that are still employed a year after their beginning employment date; and (5) Review of candidate records for date of job offer to date of employment. Deduction Schedule: Deductions shall be assessed as follows: (1) No payment; (2) 20% deduction of fee for candidates referred if minimum requirement is not met; (3) 20% deduction of fee for candidates that fill lower priority areas; (4) 5/12 of fee reduced or paid back for each month shy of a year employment at the respective Service Unit; and (5) 5% deduction of fee. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. PROJECT OFFICER: The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Project Officer. The Contractor agrees to include the following information on each invoice: (1) Contractor's name and address; (2) Contract Number; (3) Invoice number and date; (4) The name of the candidate(s), applicable discipline(s), IHS Service Unit location(s) and total amount due; and (5) Remit to address. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) METHODOLOGY AND APPROACH = 30 POINTS. The offerors must submit an explanation of the proposed technical approach in conjunction with the tasks outlined in the statement of work; (2) EXPERIENCE/TECHNICAL CAPABILITIES = 40 POINTS. The offerors must demonstrate and possess necessary qualifications, skills, abilities and experience to perform the work ; and (3) PAST PERFORMANCE INFORMATION = 30 POINTS. The offeror must demonstrate its record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. The offeror must list at least two contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable; and (8) Administrative Contracting Officer and telephone number, if applicable. Technical and past performance, when combined, are approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The following FAR and Health and Human Services Acquisition Regulation (HHSAR) clauses are applicable: 52.204-4, 52.204-9, 52.212-4, 52.212-5, 52.215-5, 52.216-18, 52.216-19, 52.216-22, 52.217-8, 52.217-9, 52.223-6, 52.224-1, 52.224-2, 52.229-3, 52.232-18, 52.237-3, 52.242-15, 52.242-17, 352.202-1, 352.215-1, 352.215-70, 352.223-70, 352.224-70, 352.232-9, 352.270-2, 352.270-3, 352.270-4, 352.270-6, 352.270-7, 352.270-10, 352.270-11, and 352.270-19. The following FAR clauses cited in 52.212-5 are applicable to the acquisition: 52.203-6 with Alternate I, 52.219-8, 52.219-28, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-39, 52.225-13 and 52.232-33. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the technical evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 2:00 p.m., on August 22, 2008. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your name and address. Offers will also be accepted by e-mail at Rita.Langager@ihs.gov or by fax at (406) 247-7108. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government.
