- This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION ARE NOT AVAILABLE. The Request for Quotation/reference number is FDA-1044634. The FDA intends to issue a Purchase Order in accordance with FAR 13.106. The NAICS code is 334516. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-26. This notice is seeking competitive bids for the attached Becton Dickinson and Company instrument or equivalent only (see description attached for a Flow Cytometer). It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses: www.acqnet.gov. The provision 52.212-1, Instructions to Offerors-Commercial applies to this acquisition. Offerors should complete their representations and certifications at Online Representations and Certifications Application (ORCA) at http://orca.bpn.gov. The Food and Drug Administration requests responses from qualified sources capable of providing these services in accordance with the attached. FAR provision 52.212-2, Evaluation-Commercial Items applies. All offers will be evaluated on technical factors and price with technical being more important than price. Technical factors will be on how the services conform to the statement of work. FAR Provision, 52.212-3, Offeror Representations and Certifications applies, if the contractor is not registered in ORCA, the vendor shall complete and submit with offer. FAR Clauses 52.212-4 and 52.212-5 apply. The FAR clauses cited in the clause are applicable to this acquisition: 52.219-28, 52.222-3, 52.222-21, 52.222-26, 52.222-36, 52.222-36, 52.222-50, 52.225-13, 52.232-33, and 52.239-1. Government reserves the right to award a purchase order without discussion if the Contracting Officer determines that the initial offer(s) is/are providing the Best Value and discussions are not necessary. The total number of pages for the technical plan is not expected to exceed ten (25) pages in length CCR: Vendors must be registered in the Central Contractor Register (CCR) prior to the award of a contract. You may register by going to www.ccr.gov. All questions are to be submitted via email to patricia.wright@fda.hhs.gov no later than August 4, 2008 10:00 AM EST. NO PHONE CALLS WILL BE ACCEPTED. This is a REQUEST FOR QUOTATION (RFQ). This announcement constitutes the only solicitation and a written solicitation will not be issued. All quotations are due, via email to: patricia.wright@fda.hhs.gov no later than 2:00pm, EST by the response date. FDA anticipates an award soon after the response date. Evaluation/Award will be based on the technically acceptable quote that offers the best value to the Government. The award will be made in accordance with FAR Part 13, Simplified Acquisition Procedures.
